DICE FM TICKET PURCHASE TERMS

Please read these Purchase Terms carefully as they set out the terms on which you purchase a ticket on the DICE FM mobile app (the "App") or via the services, features, content, applications, websites, or widgets offered by DICE (the “Services”). All purchases for tickets and other goods and services are subject to these Purchase Terms. If you have any questions about them, please contact us at help@dice.fm. We may change these Purchase Terms from time to time so please check our website at www.dice.fm from time to time for any updates to ensure that you are aware of the current terms. Your continued use of the App or the Services following any update to these Purchase Terms will constitute your acceptance of those changes. These Purchase Terms incorporate our Terms of Use by this reference.
1. ABOUT US
1.1. We are DICE FM Limited, a company registered in England and Wales under number 08905651 and our registered office is at 92-96 De Beauvoir Road, London N1 4EN.
1.2 We are a disclosed ticketing agent selling tickets via our App and the Services on behalf of promoters, organisers, managers, artists and venues of music, entertainment, sports and similar events (our "Event Partners"). We sell tickets allocated to us by our Event Partners, so the tickets we have available for sale for each event will vary and we do not control the ticket inventory or availability.
2. CONTRACT
2.1 Any ticket purchased or otherwise acquired (“Purchased”) through the App is subject to:
these Purchase Terms;
our Terms of Use;
our Privacy Policy; and
Our Event Terms and Conditions;
any additional terms and conditions of the relevant Event Partner(s) which can be found on their respective websites or at the venue itself or which are disclosed during the order process.
2.2 We facilitate the Purchase of tickets for events, and from time to time, where expressly stated we may act as a promoter or organiser of an event. Where DICE is not involved in any organisational aspect of the events offered for sale, we exclude any liability and/or responsibility for the quality or nature of any event including (but not limited to) your view at the venue where the event or show takes place, the sound quality, local conveniences or accessibility.
2.3 When you purchase a ticket you obtain a right to attend the event as granted by the relevant Event Partner. The relevant Event Partner will be shown in the event listing in the App or on the Services, preceded by the words: “Presented by”. We make available tickets on behalf of third party Event Partners who are not connected in any way with DICE. Those third party Event Partners are responsible to you for the relevant event. For the avoidance of doubt, from time to time, DICE may be the Event Partner.
2.4 Any changes to an event that occur after you have Purchased a ticket (such as a change of date, location, programme, or artist, or an event cancellation) are the sole responsibility of the Event Partner for that event. Please see Clause 3, which sets out how we will inform you of any changes to an event.
2.5 By hitting the ‘Purchase Tickets’ button in the App or the Services, you are making a contractual offer to purchase the ticket(s). This offer is only accepted by DICE on behalf of, or acting as the Event Partner once you receive a confirmation email from us.
2.6 Upon Purchase of a ticket as well as on the day of the event you will receive a confirmation to the email address provided to us during your registration to the App or the Services containing any additional details about the event. It is your responsibility to check these details carefully before the event. The ticket stored on the App, found by clicking on the 'tickets' option of the App menu, is required for entry to the venue and must be presented upon request for each ticket holder. Note that for certain events, a hardcopy ticket may be provided to you. In these circumstances, we will notify you by telephone, email or within the App of the arrangements for receiving or collecting your tickets. You may be asked by the venue to separately verify your identity and/or age by providing ID for events with age restrictions.
2.7 When Purchasing tickets via the App or the Services, you will be limited to a maximum number of tickets for each event (as specified in the order page of the App or the Services).
2.8 We may make available certain goods (for example, merchandise), services and digital content (“Non-Ticket Items”) for purchase via the App. Please see Clauses 13 and 14 below for more information.
3. CANCELLATIONS, POSTPONEMENTS AND CHANGES
3.1 Once you have Purchased a ticket, it cannot be exchanged or refunded except in the following circumstances:
If an event is cancelled by the Event Partner, they are responsible for refunding the original ticket proceeds to you. DICE will arrange for the full refund to ticket holders on the Event Partner’s behalf and subject to us obtaining the funds to be provided from or on behalf of the Event Partner. We aim to do this within five (5) working days of the Event Partner returning the original proceeds to us to enable us to process refunds.
If an event is postponed by the Event Partner, ticket holders will be given the option to either exchange their existing ticket for a new ticket for the rescheduled event date or receive a full refund.
In accordance with our Waiting List feature for sold out events, where applicable. Please see Clauses 6 and 7 below for details.
3.3 If an Event Partner notifies us of any changes to an event, or we are aware of any significant changes to an event where DICE is the Event Partner, we will:
Send a message to the mobile phone number or email address specified by you when registering with the App or the Services informing you of the change; and
Inform you about the Event Partner's procedure for reimbursements and refunds, where appropriate.
3.4 We will not reimburse the cost of Purchased tickets after an event has taken place unless instructed otherwise by, and at the discretion of, the Event Partner. You will not be entitled to a refund if you fail to attend an event or make an error when purchasing tickets (for example you buy the wrong quantity).
4. PRICES AND FEES
4.1 The price of the ticket(s) or Non-Ticket Item(s) listed in the App includes VAT and will be the price indicated on the order pages of the App when you placed your order.
4.2 We accept payment with Visa, MasterCard, American Express, Apple Pay, Android Pay and any other payment methods indicated in the App. You must pay for your order before the ticket(s) or Non-Ticket Item(s) will be provided to you.
4.3 We take all reasonable care to ensure that the price of the ticket(s) or Non-Ticket Item(s) set out in the App or the Services is correct. If we discover an error in the price in your order, we will contact you to give you the option of either reconfirming your order at the correct price, or cancelling your order. We will debit or refund the method you used for payment of the order, as applicable. If we are unable to contact you, you agree that we may treat your order as cancelled.
4.4 If you need a VAT invoice in respect of a ticket (or tickets), you should contact the relevant Event Partner.
5. SEAT SELECTION
5.1 Some tickets available on the App or the Services will be issued for a particular seat or seating area at the event venue. When ordering such tickets, the App or the Services may give you the option of selecting your preferred seating area (rather than individual seat numbers).
5.2 Where you have selected a seating area when placing your order for the tickets, we may contact you at a later date and before the event to give you the option of selecting a particular seat number for your ticket(s) (“Set Seat”), so long as you inform us of your selection via the App or the Services and within the timeframe provided to you by us. Please note that you may be required to pay a small charge to us via the App or the Services, in addition to the ticket price, in order to select a Set Seat. We will notify you of this charge when giving you the option to select a Set Seat.
5.3 Where you do not select a Set Seat under Clause 5.2, we may allocate individual seat number(s) to you for your ticket(s) within the seating area you selected when placing your order. We will notify you of your seat numbers via the App or the Services and prior to the event. We will endeavour to ensure that where you have ordered more than one ticket, each ticket will be allocated seats that are next to each other. If you have any questions in relation to seat allocation please contact us at help@dice.fm.
5.4 DICE has the right to provide alternative seats of an equal value.
5.5 Any seating charts shown via the App will reflect the general layout of the venue at that time. For some events the layout and specific seat locations may vary without notice.
6. WAITING LISTS REFUNDS
6.1 When an event has sold out and as agreed with the Event Partner, DICE may enable the Waiting List feature for that event.
6.2 Where the conditions of Clause 6.1 have been met, you may have the option to offer your ticket to the Waiting List via the App or the Services in order for it to be offered to other users of the App or the Services, so long as the return is made prior to the Event Partner’s deadline. This deadline is at the discretion of the Event Partner, though DICE endeavours to make the deadline as close as possible to the stated event time.
6.3 Once you have agreed to offer your ticket to the Waiting List, you forfeit your rights to the ticket(s) and they will no longer exist in your account during the Waiting List period. If the ticket(s) offered is not successfully Purchased by another user from the Waiting List, the ticket(s) will be returned to your account prior to the Event Partner’s deadline, and you will be able to use the ticket, but not be eligible for a refund. If the ticket(s) is successfully Purchased by another user from the Waiting List before the deadline, it will be deemed to have been resold by the Event Partner to the new purchaser as described in Clause 2.3, your rights to the ticket will cease entirely, and a full refund of your original Purchase for that ticket(s) will be provided to you. You will not be paid the difference (if any) between the original Purchase price and the price for which the ticket was resold for, if higher (with such difference being the “Waiting List Fee”).
7. WAITING LISTS PURCHASES
7.1 The App or the Services may allow you to sign up to the Waiting List for an event. If additional tickets are available for Purchase either by the Event Partner providing DICE with more tickets to sell on its behalf, or other users returning their Purchased tickets to the Waiting List in accordance with Clause 6.2, you will be notified and given a limited time period in which to Purchase the tickets through the App (“Timeframe”).
7.2 The ticket(s) Purchased via the Waiting List are subject to a higher price above the original price of the ticket(s). The Waiting List price you see in the App or the Services is the total higher price for that ticket when purchased through the Waiting List feature, including the Waiting List Fee.
7.3 If you have joined the Waiting List and offered a ticket(s), you are under no obligation to Purchase.
7.4 Failure to complete a Purchase of ticket(s) offered to you within the Timeframe will result in the tickets being offered to the next person on the Waiting List. Users who miss an opportunity to Purchase tickets offered to them from a Waiting List during the Timeframe may contact help@dice.fm in order to be placed back on the Waiting List. A user added back on to the Waiting List in this way will join at the end of the Waiting List (and will not be given their original position).
7.5 You acknowledge that joining a Waiting List does not guarantee you will successfully Purchase a ticket that becomes available. We are also not responsible if you fail to receive a notification or complete a transaction within the Timeframe in order to successfully Purchase the offered ticket(s).
8. ACCIDENTAL PURCHASES
8.1 You are responsible for checking the event details before Purchasing a ticket to ensure that the event’s artist, date, time, location, age limit, and any other restrictions are correct and acceptable to you. You will not be eligible for a refund in instances where such restrictions prevent your attendance.
9. NON RESALE OF TICKETS
9.1 You may not resell or transfer your tickets, except for under (i) the ‘Limited Right to Transfer Tickets’ feature described below in Clause 10, and only if such reselling or transfer is not prohibited by law or by the relevant Event Partner, or (ii) the ‘Waiting List’ feature specified in Clause 6. Further, you may not duplicate a ticket, for example, by taking a screenshot of the ticket on your device.
9.2 Any resale or transfer (or attempted resale or transfer) of a ticket in breach of Clause 9.1 is grounds for the immediate confiscation, invalidation, or cancellation of that ticket without refund or other compensation, and may result in full suspension of your use of the ticket transfer feature or full suspension of the original ticket holder’s use of the App in general, at DICE’s sole discretion.
10. LIMITED RIGHT TO TRANSFER TICKETS
10.1 For certain events a person who has purchased a ticket (a "Sender") may be permitted to transfer the ticket via the App to another registered DICE user (a "Recipient"). This can be done at any time prior to the ticket transfer cut-off date and time specified by the Event Partner, provided that the conditions below are met:
the Recipient has a device compatible with the App; and
the Recipient's mobile number associated with the App is stored and accessible from the contact list or phone book of the Sender’s personal device; and
the Recipient has downloaded the most recent and updated version of the App to their phone; and
the Recipient has successfully registered and created a DICE account using the device and mobile number mentioned above.
10.2 DICE provides this feature to facilitate the transfer of the rights to a ticket only. The transfer does not extend to the payment for the ticket, which must be arranged separately and directly between the Sender and the Recipient.
10.3 Due to restrictions placed on DICE by Event Partners, only tickets for certain events may be transferred using this feature. If the event does not allow the transfer of tickets as a feature within the App, you may contact help@dice.fm to request this manually by providing the full name and mobile number of the Recipient to whom you wish to transfer a ticket. Conditions for the Recipient to receive the ticket are as described above. You must contact DICE at least two (2) weeks in advance of the event dates if you wish to transfer a ticket in this way. If you contact us to transfer your ticket with less than this notice period, we cannot guarantee we will be able to fulfil your request. Any requests to transfer tickets in this manner that are received less than two weeks before the event may be denied at DICE’s sole discretion.
10.4 When using the ticket transfer feature the Sender is responsible for ensuring that the mobile number of the Recipient is correct for the intended purchaser of the ticket. Any ticket successfully transferred to a Recipient automatically becomes a right of that Recipient and the Sender then has no rights in relation to the ticket. DICE is not responsible for any tickets mistakenly sent to the wrong Recipient and cannot transfer the tickets in question back to the Sender without the Recipient’s prior authorisation or consent.
10.5 The Sender is responsible for requesting and arranging any payment for the ticket separately and directly with the Recipient. Any such payment must not be for a sum exceeding the face value of the ticket. DICE is not responsible for any Recipient refusing to pay any Sender. If an event is cancelled, a refund will be made to the Sender as the original ticket holder by the same means as payment for the ticket was originally made. The Sender is then responsible for remitting the refund separately and directly to the Recipient.
10.6 When requested by the Sender, Recipients of tickets are responsible for settling payment separately and directly with the Sender for an amount no greater than the face value of the ticket.
10.7 If the Recipient of a transferred ticket is unable to attend the event, the tickets may be transferred on to new Recipient or returned to the original Sender using the process set out above.
10.8 It is prohibited for any Recipient to pay more than face value for a ticket. DICE will conduct periodic checks with Recipients to ensure that no more than face value was paid for any ticket. Any Sender found to have requested or received payment from a Recipient above the face value is in breach of the terms under which the ticket was sold and that may be cause for the immediate confiscation, invalidation, or cancellation of the ticket held without any refund or other compensation and for a future restriction on the use of the ticket transfer feature or full suspension of the Sender’s use of the App in general, at DICE’s sole discretion.
11. LIABILITY
11.1 DICE assumes no responsibility for tickets Purchased through third parties or unofficial sales points. DICE is not responsible for any differences in price with other media or sales channels.
11.2 DICE is not responsible for:
loss or theft of personal mobile devices, any tickets stored within the App on a lost or stolen device or any hardcopy tickets. All events are provided with a door list with names of individuals who have Purchased tickets through the App or the Services and our Event Partners may seek to allow you to gain entry to the event without your mobile phone by speaking to a DICE or event representative who will ask for ID verification in order to allow access to the event. However, this is not guaranteed.
any personal arrangements including travel, accommodation or hospitality relating to the attendance or an event. Neither we nor the relevant Event Partner shall be liable to you for any loss of enjoyment or wasted expenditure.
any exchange or bank fees incurred by you arising from the normal course of payment or reimbursement.
11.3 Except as otherwise set out in these Purchase Terms, our liability to you in connection with:
an event (including, but not limited to, any cancellation, rescheduling or material change to the programme of the event) and the ticket you have Purchased shall be limited to the price paid by you for the ticket or £5, whichever is higher; or
a Non-Ticket Item shall be limited to the price paid by you to us for that Non-Ticket Item.
11.4 These Purchase Terms do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, fraud, or any matter for which liability cannot be lawfully excluded or restricted.
12. ACCESS TO VENUES
12.1 Your purchase of a ticket to an event via the App or Services will give you a personal revocable licence from the Event Partner to attend the event, subject always to the terms and conditions specified in these Purchase Terms. By purchasing a ticket on the App or the Services, you acknowledge that the Event Partner reserves the right, on reasonable and lawful grounds, to refuse entry to or remove from the premises any ticket holder without requirement to offer a refund or other compensation. By way of example, the Event Partner may remove a ticket holder who:
has behaved in a manner which, in the reasonable opinion of the Event Partner has, or is likely to, affect the enjoyment of other visitors; or
uses threatening, abusive or insulting words or behaviour, or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
in the reasonable opinion of the Event Partner, is under the influence of alcohol or drugs; or
fails, when required, to produce proof of identity or age (as or when appropriate).
12.2 By accepting these Purchase Terms, you acknowledge that DICE shall have no liability if you are refused entry to, or removed from, an event by an Event Partner or otherwise for the actions or inactions of the Event Partner.
13. NON-TICKET ITEMS
13.1 We may make available certain Non-Ticket Items for purchase via the App or the Services (including goods, services and digital content). Clauses 13 and 14 only apply to the purchase of Non-Ticket Items (and not to tickets).
13.2 Any Non-Ticket Item purchased through the App or the Services is subject to:
these Purchase Terms;
our Terms of Use;
our Privacy Policy; and
any additional terms and conditions of the relevant Event Partner(s) which can be found on the order pages when making a purchase.
13.3 Where the Non-Ticket Item is a physical item (for example, goods), we are under a legal duty to supply goods that are in conformity with this contract.
14. CANCELLATION RIGHTS
14.1 If you are a customer in the EU or in Norway, Liechtenstein or Iceland, you have a statutory right to cancel any order you place for certain Non-Ticket Items. If you are a non-EU customer, this cancellation right is not available to you. Please use contact us for the details of any returns policy applying to the Non-Ticket Item purchased.
14.2 Note that where we have made a Non-Ticket Item available via the App on behalf of an Event Partner, any cancellation or return of that Non-Ticket Item will also be subject to the terms and conditions of that Event Partner.
14.3 Note that you do not have a right to change your mind in respect of:
tickets or other forms of entry to an event;
any upgrades or additional services including travel, catering, accommodation, transport or services relating to leisure activities, to be provided on a specified date or during a specified period;
services, once these have been completed, even if the 14 day cancellation period is still running;
digital content after you have started to download or stream these; and
goods sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.
14.4 You have the right to change your mind and cancel a purchase made via the App for:
goods within 14 calendar days of the day on which you receive the goods;
services and subscriptions within 14 days after the day we email you to confirm we accept your order. However, once we have completed the services you cannot change your mind, even if the period is still running. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us that you have changed your mind.
digital content within 14 days after the day we email you to confirm we accept your order, or, if earlier, until you start downloading or streaming. If we delivered the digital content to you immediately, and you agreed to this when ordering, you will not have a right to change your mind.
14.5 You can cancel by emailing us at help@dice.fm or by completing a cancellation form and sending it to us via email or by post.
14.6 If you have received the goods before you have made your cancellation request to us, you will need to return the goods to us (or the Event Partner, depending on the instructions we give you) within 14 calendar days of telling us you wish to cancel. The goods must be returned in perfect original sale-able condition in the original packaging and with all tags attached, to either the Event Provider (to the address notified to you by us) or to DICE FM Limited, 92-96 De Beauvoir Road, London N1 4EN. You are responsible for any return shipping charges. For your protection, please be sure to return your goods via recorded or registered post.
14.7 We will refund you the price you paid for the goods, service or digital content including any the original delivery costs. We will make any refunds due to you as soon as possible, and in any event within 14 days after the day on which we receive (or the relevant Event Partner receives) the goods back from you or, if earlier, 14 days after the day on which you provide us with evidence that you have sent the goods back to us (or the Event Partner).
14.8 We (or the Event Partner on whose behalf we sold the relevant goods) may make deductions from the price (excluding delivery costs) to reflect any reduction in the value of goods returned, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
15. GENERAL
15.1 Certain events may be recorded for commercial and/or promotional purposes by the Event Partner. When accessing the venue or show you consent to your image being used in this way.
15.2 DICE reserves the right to obtain photographs, audio or video of all events for which DICE makes tickets available. When accessing the venue or show you consent to your image being used in this way. We may reproduce and/or publish your image in the App, our website, and in other promotional materials, social networking channels and other materials related to the App. For more information about how we use your personal information, and how to request details of the personal information that we hold about you then please see our Privacy Policy.
15.3 Except for Event Partners, who shall have the right to enforce any right expressly granted for their benefit, no one other than a party to these Purchase Terms has any right to enforce any of the terms of these Purchase Terms.
15.4 These Purchase Terms are governed by and shall be construed in accordance with English law and any disputes arising out of any transaction with DICE are subject to the exclusive jurisdiction of the English courts.

Inform you about the Event Partner's procedure for reimbursements and refunds, where appropriate.
3.3 We will not reimburse the cost of Purchased tickets after an event has taken place unless instructed otherwise by, and at the discretion of, the Event Partner. You will not be entitled to a refund if you fail to attend an event or make an error when purchasing tickets (for example you buy the wrong quantity).
4. PRICES AND FEES
4.1 The price of the ticket(s) or Non-Ticket Item(s) listed in the App includes any applicable taxes and will be the price indicated on the order pages of the App when you placed your order.
4.2 We accept payment with Visa, MasterCard, American Express, Apple Pay, Android Pay and any other payment methods indicated in the App. You must pay for your order before the ticket(s) or Non-Ticket Item(s) will be provided to you.
4.3 We take all reasonable care to ensure that the price of the ticket(s) or Non-Ticket Item(s) set out in the App is correct. If we discover an error in the price in your order, we will contact you to give you the option of either reconfirming your order at the correct price, or cancelling your order. We will debit or refund the method you used for payment of the order, as applicable. If we are unable to contact you, you agree that we may treat your order as cancelled.
5. SEAT SELECTION
5.1 Some tickets available on the App will be issued for a particular seat or seating area at the event venue. When ordering such tickets, the App may give you the option of selecting your preferred seating area (rather than individual seat numbers).
5.2 Where you have selected a seating area when placing your order for the tickets, we will contact you at a later date and before the event to give you the option of selecting a particular seat number for your ticket(s) (“Set Seat”), so long as you inform us of your selection via the App and within the timeframe provided to you by us. Please note that you will be required to pay a small charge to us via the App, in addition to the ticket price, in order to select a Set Seat. We will notify you of this charge when giving you the option to select a Set Seat.
5.3 Where you do not select a Set Seat under Section 5.2, we will allocate individual seat number(s) to you for your ticket(s) within the seating area you selected when placing your order. We will notify you of your seat numbers via the App and prior to the event. We will endeavour to ensure that where you have ordered more than one ticket, each ticket will be allocated seats that are next to each other. If you have any questions in relation to seat allocation please contact us at help@dice.fm.
5.4 Any seating charts shown via the App will reflect the general layout of the venue at that time. For some events the layout and specific seat locations may vary without notice.
6. WAITING LISTS REFUNDS
6.1 When an event has sold out and as agreed with the Event Partner, DICE FM will enable the waiting list feature (“Waiting List”) for that event.
6.2 Where the conditions of Section 6.1 have been met, you have the option to offer your ticket to the Waiting List via the App in order for it to be offered to other users of the App, so long as the return is made prior to the Event Partner’s deadline. This deadline is at the discretion of the Event Partner, though DICE FM endeavours to make the deadline as close as possible to the stated event time in the App.
6.3 Once you have agreed to offer your ticket to the Waiting List, you forfeit your rights to the ticket(s) and they will no longer exist in your account during the Waiting List period. If the ticket(s) offered is not successfully Purchased by another user from the Waiting List, the ticket(s) will be returned to your account prior to the Event Partner’s deadline, and you will be able to use the ticket, but not be eligible for a refund. If the ticket(s) is successfully Purchased by another user from the Waiting List before the deadline, it will be deemed to have been resold by the Event Partner to the new purchaser as described in Section 2.3, your rights to the ticket will cease entirely, and a full refund of your original Purchase for that ticket(s) will be provided to you. You will not be paid the difference (if any) between the original Purchase price and the price for which the ticket was resold for, if higher (with such difference being the “Waiting List Fee”).
7. WAITING LISTS PURCHASES
7.1 The App may allow you to sign up to the Waiting List for an event. If additional tickets are available for Purchase either by the Event Partner providing DICE FM with more tickets to sell on its behalf, or other users returning their Purchased tickets to the Waiting List in accordance with Section 6.2, you will be notified and given a limited time period in which to Purchase the tickets through the App (“Timeframe”).
7.2 The ticket(s) Purchased via the Waiting List are subject to a higher price above the original price of the ticket(s). The Waiting List price you see in the App is the total higher price for that ticket when purchased through the Waiting List feature, including the Waiting List Fee.
7.3 If you have joined the Waiting List and offered a ticket(s), you are under no obligation to Purchase.
7.4 Failure to complete a Purchase of ticket(s) offered to you within the Timeframe will result in the tickets being offered to the next person on the Waiting List. Users who miss an opportunity to Purchase tickets offered to them from a Waiting List during the Timeframe may contact help@dice.fm in order to be placed back on the Waiting List. A user added back on to the Waiting List in this way will join at the end of the Waiting List (and will not be given their original position).
7.5 You acknowledge that joining a Waiting List does not guarantee you will successfully Purchase a ticket that becomes available. We are also not responsible if you fail to receive a notification or complete a transaction within the Timeframe in order to successfully Purchase the offered ticket(s).
8. ACCIDENTAL PURCHASES
8.1 You are responsible for checking the event details before Purchasing a ticket to ensure that the event’s artist, date, time, location, age limit, and any other restrictions are correct and acceptable to you. You will not be eligible for a refund in instances where such restrictions prevent your attendance.
9. NON RESALE OF TICKETS
9.1 You may not resell or transfer your tickets, except for under (i) the ‘Limited Right to Transfer Tickets’ feature described below in Section 10, and only if such reselling or transfer is not prohibited by law or by the relevant Event Partner, or (ii) the ‘Waiting List’ feature specified in Section 6. Further, you may not duplicate a ticket, for example, by taking a screenshot of the ticket on your device.
9.2 Any resale or transfer (or attempted resale or transfer) of a ticket in breach of Section 9.1 is grounds for the immediate confiscation, invalidation, or cancellation of that ticket without refund or other compensation, and may result in full suspension of your use of the ticket transfer feature or full suspension of the original ticket holder’s use of the App in general, at DICE FM’s sole discretion.
10. LIMITED RIGHT TO TRANSFER TICKETS
10.1 For certain events a person who has purchased a ticket (a “Sender”) may be permitted to transfer the ticket via the App to another registered user (a “Recipient”). This can be done at any time prior to the ticket transfer cut-off date and time specified by the Event Partner, provided that the conditions below are met:
the Recipient has a device compatible with the App; and
the Recipient's mobile number associated with the App is stored and accessible from the contact list or phone book of the Sender’s personal device; and
the Recipient has downloaded the most recent and updated version of the App to their phone; and
the Recipient has successfully registered and created an App account using the device and mobile number mentioned above.
10.2 DICE FM provides this feature to facilitate the transfer of the rights to a ticket only. The transfer does not extend to the payment for the ticket, which must be arranged separately and directly between the Sender and the Recipient.
10.3 Due to restrictions placed on DICE FM by Event Partners, only tickets for certain events may be transferred using this feature. If the event does not allow the transfer of tickets as a feature within the App, you may contact help@dice.fm to request this manually by providing the full name and mobile number of the Recipient to whom you wish to transfer a ticket. Conditions for the Recipient to receive the ticket are as described above. You must contact DICE FM at least two (2) weeks in advance of a festival date or one (1) week in advance of all other event dates if you wish to transfer a ticket in this way. If you contact us to transfer your ticket with less than this notice period, we cannot guarantee we will be able to fulfil your request. Any requests to transfer tickets in this manner that are received less than two weeks before the event may be denied at DICE FM’s sole discretion.
10.4 When using the ticket transfer feature the Sender is responsible for ensuring that the mobile number of the Recipient is correct for the intended purchaser of the ticket. Any ticket successfully transferred to a Recipient automatically becomes the property of that Recipient and the Sender then has no rights in relation to the ticket. DICE FM is not responsible for any tickets mistakenly sent to the wrong Recipient and cannot transfer the tickets in question back to the Sender without the Recipient’s prior authorisation or consent.
10.5 The Sender is responsible for requesting and arranging any payment for the ticket separately and directly with the Recipient. Any such payment must not be for a sum exceeding the face value of the ticket. DICE FM is not responsible for any Recipient refusing to pay any Sender. If an event is cancelled, a refund will be made to the Sender as the original ticket holder by the same means as payment for the ticket was originally made. The Sender is then responsible for remitting the refund separately and directly to the Recipient.
10.6 When requested by the Sender, Recipients of tickets are responsible for settling payment separately and directly with the Sender for an amount no greater than the face value of the ticket.
10.7 If the Recipient of a transferred ticket is unable to attend the event, the tickets may be transferred on to new Recipient or returned to the original Sender using the process set out above.
10.8 It is prohibited for any Recipient to pay more than face value for a ticket. DICE FM will conduct periodic checks with Recipients to ensure that no more than face value was paid for any ticket. Any Sender found to have requested or received payment from a Recipient above the face value is in breach of the terms under which the ticket was sold and that may be cause for the immediate confiscation, invalidation, or cancellation of the ticket held without any refund or other compensation and for a future restriction on the use of the ticket transfer feature or full suspension of the Sender’s use of the App in general, at DICE FM’s sole discretion.
11. LIABILITY AND WARRANTY DISCLAIMERS
WITHOUT LIMITING ANYTHING SET FORTH ELSEWHERE IN THESE PURCHASE TERMS OR IN THE TERMS OF USE, YOU AGREE TO THE FOLLOWING LIMITATIONS ON LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW:
11.1 DICE FM ASSUMES NO RESPONSIBILITY FOR TICKETS PURCHASED THROUGH THIRD PARTIES OR UNOFFICIAL SALES POINTS. DICE FM IS NOT RESPONSIBLE FOR ANY DIFFERENCES IN PRICE WITH OTHER MEDIA OR SALES CHANNELS.
11.2 DICE FM IS NOT RESPONSIBLE FOR:
LOSS OR THEFT OF PERSONAL MOBILE DEVICES, ANY TICKETS STORED WITHIN THE APP ON A LOST OR STOLEN DEVICE OR ANY HARDCOPY TICKETS. ALL EVENTS ARE PROVIDED WITH A DOOR LIST WITH NAMES OF INDIVIDUALS WHO HAVE PURCHASED TICKETS THROUGH THE APP AND OUR EVENT PARTNERS MAY SEEK TO ALLOW YOU TO GAIN ENTRY TO THE EVENT WITHOUT YOUR MOBILE PHONE BY SPEAKING TO A DICE FM OR EVENT REPRESENTATIVE WHO WILL ASK FOR ID VERIFICATION IN ORDER TO ALLOW ACCESS TO THE EVENT. HOWEVER, THIS IS NOT GUARANTEED.
ANY PERSONAL ARRANGEMENTS INCLUDING TRAVEL, ACCOMMODATION OR HOSPITALITY RELATING TO THE ATTENDANCE OR AN EVENT. NEITHER WE NOR THE RELEVANT EVENT PARTNER SHALL BE LIABLE TO YOU FOR ANY LOSS OF ENJOYMENT OR WASTED EXPENDITURE.
ANY EXCHANGE OR BANK FEES INCURRED BY YOU ARISING FROM THE NORMAL COURSE OF PAYMENT OR REIMBURSEMENT.
11.3 EXCEPT AS OTHERWISE SET OUT IN THESE PURCHASE TERMS, OUR LIABILITY TO YOU IN CONNECTION WITH:
AN EVENT (INCLUDING, BUT NOT LIMITED TO, ANY CANCELLATION, RESCHEDULING OR MATERIAL CHANGE TO THE PROGRAMME OF THE EVENT) AND THE TICKET YOU HAVE PURCHASED SHALL BE LIMITED TO THE PRICE PAID BY YOU FOR THE TICKET OR $5, WHICHEVER IS HIGHER; OR
A NON-TICKET ITEM SHALL BE LIMITED TO THE PRICE PAID BY YOU TO US FOR THAT NON-TICKET ITEM.
11.4 DICE FM SHALL HAVE NO LIABILITY IF YOU ARE REFUSED ENTRY TO, OR REMOVED FROM, AN EVENT BY ANY THIRD PARTY AND FOR ANY REASON.
11.5 FOR CLARITY, AND WITHOUT LIMITING ANYTHING SET FORTH ELSEWHERE IN THESE PURCHASE TERMS OR THE TERMS OF USE, ALL PRODUCTS AND SERVICES SOLD THROUGH THE APP ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, AND DICE FM DISCLAIMS ALL WARRANTIES RELATING TO THE SAME, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES RIGHTS AND FITNESS FOR A PARTICULAR PURPOSE.
12. NON-TICKET ITEMS
12.1 We may make available certain Non-Ticket Items for purchase via the App (including goods, services and digital content). Sections 12 and 13 only apply to the purchase of Non-Ticket Items (and not to tickets).
12.2 Any Non-Ticket Item purchased through the App is subject to:
these Purchase Terms;
our Terms of Use;
our Privacy Policy; and
any additional terms and conditions of the relevant Event Partner(s) which can be found on the App order pages when making a purchase.
13. CANCELLATION RIGHTS
13.1 Note that where we have made a Non-Ticket Item available via the App on behalf of an Event Partner, any cancellation or return of that Non-Ticket Item will also be subject to the terms and conditions of that Event Partner.
13.2 Note that you do not have a right to change your selection or cancel:
tickets or other forms of entry to an event;
any upgrades or additional services including travel, catering, accommodation, transport or services relating to leisure activities, to be provided on a specified date or during a specified period;
services, once these have been completed, even if the 14 day cancellation period is still running;
digital content after you have started to download or stream these; and
goods sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.
13.3 You have the right to change your selection and cancel a purchase made via the App for:
goods within 14 calendar days of the day on which you receive the goods;
services within 14 days after the day we email you to confirm we accept your order. However, once we have completed the services you cannot change your selection or cancel, even if the period is still running. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us that you have changed your selection or cancelled.
digital content within 14 days after the day we email you to confirm we accept your order, or, if earlier, until you start downloading or streaming. If we delivered the digital content to you immediately, and you agreed to this when ordering, you will not have a right to change your selection or cancel.
13.4 You can cancel by emailing us at help@dice.fm or by completing a cancellation form and sending it to us via email or by post.
13.5 If you have received the goods before you have made your cancellation request to us, you will need to return the goods to us (or the Event Partner, depending on the instructions we give you) within 14 calendar days of telling us you wish to cancel. The goods must be returned in perfect original sale-able condition in the original packaging and with all tags attached, to either the Event Partner (to the address notified to you by us) or to DICE FM Limited, 3500 S. DuPont Highway, Dover, DE 19901. You are responsible for any return shipping charges. For your protection, please be sure to return your goods via a reputable carrier such as FedEx.
13.6 We will refund you the price you paid for the goods, service or digital content including any the original delivery costs. We will make any refunds due to you as soon as possible, and in any event within 14 days after the day on which we receive (or the relevant Event Partner receives) the goods back from you or, if earlier, 14 days after the day on which you provide us with evidence that you have sent the goods back to us (or the Event Partner).
13.7 We (or the Event Partner on whose behalf we sold the relevant goods) may make deductions from the price (excluding delivery costs) to reflect any reduction in the value of goods returned, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
14.1. GENERAL
14.1 Certain events may be recorded for commercial and/or promotional purposes by the Event Partner. When accessing the venue or show you consent to your image being captured and used in this way.
14.2 DICE FM reserves the right to obtain photographs, audio or video of all events for which DICE FM makes tickets available, including any of the foregoing that may depict your image or likeness. When accessing the venue or show you consent to your image or likeness being captured as described in the foregoing sentence, and to us reproducing and/or publishing your image or likeness in the App, on our website, and in other promotional materials, social networking channels and other materials related to the App for our business purposes.

1. À PROPOS DE NOUS

Nous vendons des billets qui nous sont alloués par nos Partenaires d’Évènements, ainsi les billets que nous mettons en vente pour chaque évènement peuvent varier et nous ne contrôlons ni l’inventaire ni la disponibilité des billets.
2. CONTRAT
2.1 Tout billet acheté ou autrement acquis (« Acheté ») par le biais de l’Appli est soumis :
- aux présentes Conditions de Vente ;
- à nos Conditions d’Utilisation ;
- à notre Politique de Confidentialité ; et
- à toute condition additionnelle et aux conditions du Partenaire d’Évènement concerné, disponibles sur son site Internet ou sur le lieu de la salle ou communiquées pendant la commande.
2.2 Nous facilitons l’Achat de billets pour des évènements, mais n’agissons en aucun cas, sauf indication contraire expresse, comme promoteur ou organisateur d’un évènement. DICE n’est impliqué dans aucun aspect organisationnel des évènements proposés à la vente et nous ne pouvons en aucun cas être tenus responsables au regard de la qualité ou de la nature de tout évènement, y compris, mais sans s’y limiter, votre vue dans la salle accueillant l’évènement ou le spectacle, la qualité sonore, les commodités à disposition ou l’accessibilité.
2.3 En acquérant un billet, vous obtenez le droit d’assister à un évènement, tel qu’accordé par le Partenaire d’Évènement concerné. Le Partenaire d’Évènement concerné sera indiqué dans la présentation de l’évènement dans l’Appli, précédé des mots : « Présenté par ».
2.4 En cliquant sur le bouton « Acheter des billets » dans l’Appli, vous effectuez une offre contractuelle pour acheter un/des billet(s). Cette offre n’est acceptée par DICE que lorsque vous recevez un courriel de confirmation de notre part.
2.5 Après l’Achat d’un billet ainsi que le jour de l’évènement, vous recevrez une confirmation sur l’adresse électronique fournie durant votre inscription sur l’Appli contenant les détails supplémentaires concernant l’évènement. Il est de votre responsabilité de vérifier soigneusement ces détails avant l’évènement. Le billet stocké dans l’Appli, accessible en cliquant sur l’onglet « Billets » dans le menu de l’Appli, est requis pour entrer dans la salle et doit être présenté sur demande par chaque détenteur de billet. Notez que pour certains évènements, un billet imprimé peut vous être fourni. Dans ces circonstances, nous vous informerons par téléphone, courriel ou sur l’Appli des modalités pour recevoir ou récupérer vos billets. Il peut vous être demandé par la salle de confirmer votre identité et/ou votre âge en présentant une pièce d’identité pour des évènements avec des restrictions d’âge.
2.6 Lors de l’Achat de billets par le biais de l’Appli, vous serez limité à un nombre maximum de billets par évènement (nombre indiqué sur la page de commande de l’Appli).
2.7 Nous pouvons rendre disponibles certains biens (par exemple, des produits dérivés), des services et du contenu numérique (« Biens Hors-Billets ») à l’achat par le biais de l’Appli. Veuillez vous reporter aux Clauses 13 et 14 ci-dessous pour de plus amples informations.>
3. ANNULATIONS, REPORTS ET MODIFICATIONS
3.1 Une fois que vous avez Acheté un billet, il ne peut ni être échangé ni remboursé, sauf dans les circonstances suivantes :
- Si un évènement est annulé. DICE organisera le remboursement intégral des détenteurs de billet. Nous avons pour objectif de le faire dans les cinq (5) jours ouvrés à partir de la date d’annulation de l'événement.
- Si un évènement est reporté par le Partenaire d’Évènement, les détenteurs de billets auront le choix entre échanger leurs billets existant contre des billets pour la nouvelle date de l’évènement ou recevoir un remboursement intégral,
- conformément à notre fonctionnalité de Liste d’Attente pour les évènements complets, le cas échéant. Veuillez vous reporter aux Clauses 6 et 7 ci-dessous pour de plus amples informations.
3.2 Si un Partenaire d’Évènement nous informe de tout changement concernant un événement, nous :
- Vous enverrons un message sur le numéro de téléphone ou l’adresse électronique que vous avez renseignée lors de votre inscription sur l’Appli vous informant de tels changements ; et
- Vous informerons, le cas échéant, sur la procédure de remboursement et de restitution.
3.3 Nous ne rembourserons pas le prix de billets Achetés après qu’un événement ait eu lieu, sauf instruction contraire, et à la seule discrétion, du Partenaire d’Évènement. Vous n'aurez droit à aucun remboursement si vous n'hésitez pas à un événement ou si vous faites une erreur lors de l’achat de billets (par exemple, si vous achetez la mauvaise quantité de billets).
4. PRIX ET FRAIS
4.1 Le prix du/des billet(s) ou des Biens Hors-Billets répertoriés dans l’Appli inclut la TVA et sera le prix indiqué sur les pages de commande de l’Appli lorsque vous passez votre commande.
4.2 Nous acceptons les paiements par Visa, MasterCard, American Express, Apple Pay, Android Pay et tout autre moyen de paiement indiqué dans l’Appli. Vous devez régler votre commande avant de pouvoir obtenir le(s) billet(s) ou le(s) Bien(s) Hors-Billets.
4.3 Nous prenons toutes les mesures raisonnables pour garantir que le prix du/des billet(s) ou Bien(s) Hors-Billets affiché dans l’Appli est correct. Si nous découvrons une erreur dans le prix de votre commande, nous vous contacterons pour vous offrir le choix de reconfirmer votre commande au prix correct ou d’annuler votre commande. Nous utiliserons la méthode de paiement utilisée pour le règlement de la commande afin d’effectuer le débit ou le remboursement. Si nous ne réussissons pas à vous contacter, vous acceptez que nous traitions votre commande comme annulée.
4.4 Si vous avez besoin d’une facture incluant la TVA pour l’achat d’un billet (ou de billets), vous devez contacter help@dice.fm et nous demander la dite facture.
5. CHOIX DES SIÈGES
5.1 Certains billets disponibles sur l’Appli seront émis pour un siège ou une zone de placement donné au sein de la salle de l’évènement. Lors de la commande de tels billets, l’Appli peut vous offrir la possibilité de sélectionner la zone de placement que vous préférez (plutôt que des numéros de sièges individuels).
5.2 Si vous avez sélectionné une zone de placement lors de votre commande de billets, nous vous contacterons ultérieurement et avant l’évènement pour vous permettre de choisir un numéro de siège particulier pour votre/vos billet(s) (« Siège Défini »), dans la mesure où vous nous informez de votre choix par le biais de l’Appli et dans le délai que nous vous accordons. Veuillez noter qu’il vous faudra nous régler des frais minimes par le biais de l’application, en plus du prix du billet, afin de sélectionner un Siège Défini. Nous vous informerons de ces frais lorsque la possibilité de choisir un Siège Défini vous sera offerte.
5.3 Si vous ne choisissez pas de Siège Défini en vertu de la Clause 5.2, nous vous attribuerons un numéro de siège individuel pour chacun de vos billets dans la zone de placement choisie lors de votre commande. Nous vous avertirons avant la tenue de l’évènement des numéros de vos sièges par le biais de l’Appli. Si vous avez commandé plusieurs billets, nous nous efforcerons de faire en sorte que les sièges attribués à ces billets soient situés les uns à côté des autres. 5.4 Tout plan de salle présenté par le biais de l’Appli reflétera la disposition générale de la salle au moment donné. Pour certains évènements, la disposition et l’emplacement spécifiques des sièges peuvent varier sans préavis.
6. REMBOURSEMENTS LIÉS À LA LISTE D’ATTENTE
6.1 Si un évènement est complet et en accord avec le Partenaire d’Évènement, DICE activera la fonctionnalité de Liste d'Attente pour cet évènement.
6.2 Si les conditions de la Clause 6.1 ont été remplies, vous avez la possibilité de proposer votre billet sur la Liste d'Attente par le biais de l’Appli afin qu’il soit acheté par d’autres utilisateurs de l’Appli, dans la mesure où la restitution est effectuée avant le délai fixé par le Partenaire d’Évènement. Ce délai est à la discrétion du Partenaire d’Évènement, DICE met toutefois tout en œuvre pour que celui-ci soit aussi proche que possible de la date de l’évènement indiqué dans l’Appli.
6.3 Une fois que vous avez accepté de proposer votre (vos) billet(s) sur la Liste d'Attente, vous renoncez à tous vos droits sur ce(s) billet(s) et il(s) n’existera plus au sein de votre compte pendant la durée de la Liste d'Attente. Si le(s) billet(s) proposé(s) n’est pas Acheté(s) avec succès par un autre utilisateur sur la Liste d'Attente, le(s) billet(s) sera recrédité(s) sur votre compte avant la fin du délai, et vous pourrez utiliser le(s) billet(s), mais vous n’aurez droit à aucun remboursement. Si le/les billet(s) est Acheté(s) avec succès par un autre utilisateur sur la Liste d'Attente avant la fin du délai, il(s) sera considéré comme ayant été revendu au nouvel acheteur comme décrit par la Clause 2.3, tous vos droits sur le(s) billet(s) cesseront, et vous serez intégralement remboursé du prix d’Achat original du (des) billet(s). Le cas échéant, la différence entre le prix d’Achat original et le prix de revente du billet ne vous sera pas réglée, si ce dernier est supérieur (une telle différence constituant les « Frais de Liste d'Attente »).
7. ACHAT SUR LA LISTE D’ATTENTE
7.1 L’Appli peut vous permettre de vous inscrire sur la Liste d'Attente pour un évènement donné. Si des billets supplémentaires sont disponibles à l’Achat, que ce soit car le Partenaire d’Évènement fournit à DICE davantage de billets à vendre en son nom ou car d’autres utilisateurs restituent leurs billets achetés sur la Liste d'Attente conformément à la Clause 6.2, vous serez averti et disposerez d’un délai limité pour Acheter des billets par le biais de l’Appli (« Délai »).
7.2 Le(s) billet(s) Acheté(s) par le biais de la Liste d'Attente peuvent être proposés à un prix supérieur au prix original du/des billet(s). Le prix de la Liste d'Attente affiché dans l’Appli est le prix total plus élevé de ce billet lorsqu’il est acheté par le biais de la fonctionnalité de Liste d'Attente, incluant les Frais de Liste d'Attente.
7.3 Si vous avez rejoint la Liste d'Attente et qu’un billet vous est proposé, vous n’êtes soumis à aucune obligation d’achat.
7.4 En cas de non-Achat d’un billet(s) qui vous est proposé dans le Délai, celui-ci sera proposé à la prochaine personne sur la Liste d'Attente. Les utilisateurs qui ratent l’occasion d’Acheter des billets qui leur sont proposés sur la Liste d'Attente pendant le Délai peuvent contacter help@dice.fm afin d’être replacés dans la Liste d'Attente. Un utilisateur ajouté une nouvelle fois sur la Liste d'Attente de cette façon rejoindra la fin de la Liste d'Attente (et ne retrouvera pas sa position originale).
7.5 Vous reconnaissez que l’inscription à la Liste d'Attente ne garantit pas que vous pourrez Acheter avec succès un billet qui devient disponible. Nous déclinons également toute responsabilité si vous ne recevez pas de notification ou si vous ne terminez pas une transaction pendant le Délai, vous empêchant d’Acheter le(s) billet(s) proposé(s).
8. ACHATS ACCIDENTELS
8.1 Vous êtes responsable d’examiner les détails de l’évènement avant d’Acheter un billet afin de vérifier si l’artiste, la date, l’heure, le lieu, la limite d’âge, et toute autre restriction de l’évènement vous sont corrects et acceptables. Vous ne pourrez recevoir de remboursement si de telles restrictions vous empêchent d’assister à un évènement.
9. NON-REVENTE DES BILLETS
9.1 Vous ne pouvez ni revendre ni céder vos billets, sauf dans le cadre de (i) la fonctionnalité du « Droit Limité de Cession de Billets » décrite ci-dessous dans la Clause 10, et seulement si une telle revente ou cession n’est pas interdite par la loi ou par les termes appliqués à l'événement concerné ou (ii) la fonctionnalité de « Liste d'Attente » spécifiée dans la Clause 6. En outre, vous ne pouvez pas dupliquer un billet, par exemple, en prenant une capture d’écran du billet sur votre appareil.
9.2 Vous reconnaissez et acceptez que toute revente ou cession (ou tentative de revente ou cession) d’un billet en violation de la Clause 9.1 constitue un motif de confiscation, d’invalidation, ou d’annulation de ce billet sans remboursement ni autre compensation, et peut, à la seule discrétion de DICE, entraîner une suspension totale de votre utilisation de la fonctionnalité de transfert de billets ou une suspension totale de l’utilisation de l’Appli en général par le détenteur original du billet.
10. DROIT LIMITÉ DE CESSION DE BILLETS
10.1 Pour certains évènements, une personne qui a acheté un billet (un « Émetteur ») peut être autorisée à céder le billet par le biais de l’Appli à un autre utilisateur enregistré de DICE (un « Destinataire »). Cette opération peut être réalisée à tout moment avant la date limite de cession du billet et la date indiquée par le Partenaire d’Évènement, dans la mesure où les conditions ci-dessous sont remplies :
- le Destinataire dispose d’un appareil compatible avec l’Appli ; et
- le numéro de mobile du Destinataire lié à l’Appli est stocké et accessible dans la liste ou le répertoire de contacts de l’appareil personnel de l’Émetteur ; et
- le Destinataire a téléchargé la version la plus récente et à jour de l’Appli sur son téléphone ; et
- le Destinataire s’est inscrit et a créé avec succès un compte DICE en utilisant l’appareil et le numéro de téléphone susmentionnés.
10.2 DICE propose cette fonctionnalité seulement pour faciliter la cession gratuite des droits sur un billet.
10.3 Seulement les billets pour certains évènements peuvent être cédés en utilisant cette fonctionnalité. Si l'événement n’offre pas une fonctionnalité de cession de billets dans l’Appli, vous pouvez contacter help@dice.fm pour demander une cession manuelle en renseignant le nom complet et le numéro de mobile du Destinataire à qui vous souhaitez céder un billet. Les conditions pour que le Destinataire reçoive le billet sont décrites ci-dessus. Vous devez contacter DICE au moins deux (2) semaines en amont de la date d’un festival ou une (1) semaine en amont de la date de tout autre évènement, si vous souhaitez céder un billet de cette façon. Si vous nous contactez pour céder votre billet passé ce délai de préavis, nous ne pouvons garantir que nous pourrons répondre à votre demande. Toute demande de cession de billets selon cette méthode reçue moins d’une semaine avant l’évènement peut être refusée à la seule discrétion de DICE.
10.4 En utilisant la fonctionnalité de cession, l’Émetteur est tenu de vérifier que le numéro de mobile du Destinataire est correct pour l’achat de billet envisagé. Tout billet(s) cédé(s) avec succès à un Destinataire devient automatiquement un droit de ce Destinataire et l’Émetteur ne dispose plus d’aucun droit lié à ce billet. DICE n’est pas responsable en cas d’envoi par erreur au mauvais Destinataire et ne peut pas retransférer le billet concerné à l’Émetteur sans l’autorisation ou le consentement préalable du Destinataire.
10.5 L’Émetteur est responsable de demander et de convenir de tout paiement pour le billet indépendamment et directement avec le Destinataire. Un tel paiement ne doit pas être d’un montant supérieur à la valeur nominale du billet. DICE n’est pas tenu responsable de tout Destinataire refusant de payer tout Émetteur. Si un évènement est annulé, l’Émetteur sera remboursé en tant que détenteur original du billet par le biais de la méthode de paiement utilisée pour acheter le billet. L’Émetteur est alors responsable de transférer le remboursement indépendamment et directement au Destinataire.
10.6 Sur demande de l’Émetteur, le Destinataire d’un billet est tenu d’opérer le paiement indépendamment et directement avec l’Émetteur pour un montant qui ne peut être supérieur à la valeur nominale du billet.
10.7 Si le Destinataire d’un billet cédé ne peut assister à l’évènement, le billet peut être cédé à un nouveau Destinataire ou retransféré à l’Émetteur original en utilisant le procédé énoncé ci-dessus.
10.8 Il est interdit à tout Destinataire de payer plus cher que la valeur nominale d’un billet. DICE conduira des vérifications périodiques auprès des Destinataires afin de s’assurer qu’aucun billet n’a été acheté plus cher que sa valeur nominale. S’il s’avère qu’un Émetteur a demandé ou reçu un paiement supérieur à la valeur nominale de la part d’un Destinataire, il viole les conditions selon lesquelles le billet a été vendu et cela peut entraîner, à la seule discrétion de DICE, la confiscation, l’invalidation, ou l’annulation du billet détenu sans remboursement ni autre compensation, et une future restriction de l’utilisation de la fonctionnalité de cession de billet ou une suspension complète de l’utilisation de l’Appli en général par l’Émetteur.
11. RESPONSABILITÉ
11.1 DICE n’assume aucune responsabilité pour les billets Achetés auprès des tierces parties ou des points de vente non officiels. DICE n’est pas responsable de toute différence de prix avec d’autres médias ou circuits de distribution.
11.2 DICE n’est pas responsable en cas de :
- perte ou de vol des appareils mobiles personnels, et pour tout billet stocké dans l’Appli d’un appareil volé ou perdu ou de billets imprimés. Pour chaque évènement une liste contenant les noms des individus ayant Acheté des billets par le biais de l’Appli est éditée, ainsi nos Partenaires d’Évènements peuvent éventuellement vous permettre d’entrer sans votre téléphone mobile en parlant à un agent de DICE ou un représentant de l’évènement qui demandera à vérifier votre pièce d’identité afin de vous autoriser à accéder à l’évènement. Cela n’est toutefois pas garanti.
- tout arrangement personnel incluant le voyage, l’hébergement ou l’accueil, lié à la participation ou à un évènement. Ni nous ni le Partenaire d’Évènement concerné ne pouvons être tenus responsables envers vous de tout défaut de plaisir ou dépense engagée inutilement.
- tous les frais bancaires ou d’échange engagés par vous dans le cadre du déroulement normal d’un paiement ou remboursement.
11.3 Sauf indication contraire prévue aux présentes Conditions de Vente, notre responsabilité envers vous liée à :
- un évènement (y compris, mais sans s’y limiter, toute annulation, reprogrammation ou modification significative du programme de l’évènement) et au billet que vous avez Acheté se limitera au prix que vous avez payé pour le billet ou à 5 euros, la valeur la plus élevée étant retenue ; ou
- un Bien Hors-Billets se limitera au prix que vous nous avez payé pour ce Bien Hors-Billets.
11.4 Les présentes Conditions de Vente n’excluent pas notre responsabilité envers vous en cas de dommages corporels ou de décès résultant de notre négligence, fraude ou toute autre circonstance pour laquelle une telle responsabilité ne peut être légalement exclue ou restreinte.
12. ACCÈS AUX SALLES
12.1 Votre achat d’un billet pour un évènement par le biais de l’Appli ou des Services vous accordera une licence personnelle révocable de la part du Partenaire d’Évènement pour assister à l’évènement, toujours sujette aux conditions et modalités spécifiées aux présentes Conditions de Vente. En achetant un billet sur l’Appli, vous reconnaissez que le Partenaire d’Évènement se réserve le droit, pour des motifs raisonnables et légaux, de refuser l’entrée ou d’expulser des lieux tout détenteur de billet(s) sans obligation d’offrir un remboursement ou toute autre compensation. À titre d’exemple, le Partenaire d’Évènement peut expulser un détenteur de Billet qui :
- s’est comporté d’une manière qui, selon l’avis raisonnable du Partenaire d’Évènement, a, ou est susceptible de, affecter la satisfaction des autres spectateurs ; ou
- tient des propos à caractère menaçant, injurieux ou insultant ou se comporte de manière menaçante, injurieuse ou insultante, ou provocante ou d’une manière qui pourrait troubler l'ordre public ; ou
- selon l’avis raisonnable du Partenaire d’Évènement, est sous l'influence de drogues ou de l'alcool ; ou
- ne peut, lorsqu’on lui demande, fournir une preuve de son identité ou de son âge (si besoin est).
12.2 En acceptant les présentes Conditions de Vente, vous reconnaissez que DICE décline toute responsabilité si l’accès à un évènement vous est refusé ou que vous en êtes expulsé par le Partenaire d’Évènement ou pour toutes les actions ou inactions du Partenaire d’Évènement.
13. BIENS HORS-BILLETS
13.1 Nous pouvons rendre disponibles certains Biens Hors-Billets à l’achat par le biais de l’Appli (incluant des biens, des services et du contenu numérique). Les Clauses 13 et 14 ne s’appliquent qu’à l’achat de Biens Hors-Billets (et non aux billets).
13.2 Tout Bien Hors-Billets acheté par le biais de l’Appli est soumis :
- aux présentes Conditions de Vente ;
- à nos Conditions d’Utilisation ;
- à notre Politique de Confidentialité ; et
- à toute condition additionnelle et aux conditions du/des Partenaire(s) d’Évènement correspondant, disponibles dans les pages de commande de l’Appli lorsque vous effectuez un achat.
13.3 Lorsque le Bien Hors-Billet est un objet physique (par exemple, des biens), nous sommes tenus par la loi de fournir des biens conformes au présent contrat.
14. DROITS DE RÉTRACTATION
14.1 Si vous êtes un consommateur de l’UE ou de la Norvège, du Liechtenstein ou de l’Islande, vous disposez d’un droit légal d’annuler toute commande passée pour certains Biens Hors-Billets. Si vous êtes un consommateur d’un pays hors de l’UE, vous ne disposez pas de ce droit de rétractation. Veuillez nous contacter pour avoir les détails des politiques de retour qui s’appliquent au Bien Hors-Billet acheté.
14.2 Notez que lorsque nous rendons un Bien Hors-Billet disponible à l’achat par le biais de l’Appli, toute rétractation ou tout retour de ce Bien Hors-Billet sera également soumis aux conditions générales de l'événement.
14.3 Notez que vous ne disposez pas du droit de changer d’avis concernant :
- les billets ou toute autre forme d’entrée pour un évènement ;
- toute amélioration ou tout service additionnel incluant le voyage, la restauration, l’hébergement, le transport ou les services liés aux activités de loisirs, fourni à une date spécifique ou pendant une période donnée ;
- les services, une fois qu’ils ont été fournis, même si la période de rétractation de 14 jours court toujours ;
- le contenu numérique, une fois que vous avez lancé son téléchargement ou écoute en streaming ; et
- les biens scellés pour des raisons sanitaires ou d’hygiène, une fois qu’ils ont été descellés après réception.
14.4 Vous avez le droit de changer d’avis et d’annuler une commande passée par le biais de l’Appli pour :
- Les biens hors-billets, dans un délai de 14 jours calendaires à compter de la réception ;
- les services et abonnements, dans un délai de 14 jours à partir du jour où nous vous avons contacté par courriel pour confirmer que nous acceptions votre commande. Toutefois, une fois que les services ont été fournis, vous ne pouvez plus changer d’avis, même si ce délai court toujours. Si vous annulez alors que nous avons commencé à fournir les services, vous devez nous payer pour les services fournis jusqu’au moment où vous nous avez prévenus que vous changiez d’avis ;
- le contenu numérique, dans un délai de 14 jours à partir du jour où nous vous avons contacté par courriel pour confirmer que nous acceptions votre commande, ou, si c’est antérieur, jusqu’au moment où vous commencez le téléchargement ou le streaming. Si le contenu numérique vous est livré immédiatement et que vous acceptez cela lors de la commande, vous n’aurez pas le droit de changer d’avis.
14.5 Vous pouvez vous rétracter en nous contactant par courriel à l’adresse help@dice.fm ou en remplissant un formulaire de rétractation et en nous l’envoyant par courriel ou par courrier postal.
14.6 Si vous avez reçu les biens avant de procéder à votre demande de rétractation, vous devrez nous retourner les biens (ou au Partenaire d’Évènement, en fonction des consignes que nous vous donnons) dans les 14 jours calendaires suivant votre demande de rétractation. Les biens doivent être retournés dans leur état original et en parfaite condition dans leur emballage d’origine et avec toutes les étiquettes encore attachées, au Partenaire d’Évènement (à l’adresse transmise par nos soins) ou à DICE FM Limited, 92-96 De Beauvoir Road, Londres, N1 4EN. Les frais d’expédition engagés pour tout retour seront à votre charge. Pour votre protection, veuillez retourner vos biens en courrier recommandé avec accusé de réception ou remis contre récépissé.
14.7 Nous vous rembourserons le prix que vous avez payé pour les biens, services ou contenu numérique, y compris les frais de livraison originaux. Nous procéderons à tout remboursement dû aussi rapidement que possible, et dans tous les cas dans un délai de 14 jours à compter de la date à laquelle nous avons reçu (ou que le Partenaire d’Évènement concerné a reçu) les biens retournés ou si antérieurs, 14 jours à compter de la date à laquelle vous nous avez fourni une preuve que vous nous avez retourné les biens (ou au Partenaire d’Évènement).
14.8 Nous pouvons procéder à des déductions du prix (à l’exception des frais de livraison) pour refléter toute réduction de la valeur des biens retournés résultant de votre manipulation, signifiant qu’ils ne sont plus dans leur état d’origine et en parfait état dans l’emballage d’origine et avec toutes les étiquettes attachées. Si nous vous remboursons avant de pouvoir inspecter les biens et que nous découvrons plus tard que vous les avez manipulés d’une manière inacceptable, vous devrez nous régler un montant approprié.
15. GÉNÉRAL
15.1 Certains évènements peuvent être enregistrés à des fins commerciales et/ou promotionnelles par le Partenaire de l’Évènement. En accédant à la salle ou au spectacle, vous consentez à ce que votre image soit utilisée de cette façon.
15.2 DICE se réserve le droit d’obtenir des photographies, des enregistrements audio ou vidéo de tous les évènements pour lesquels DICE met des billets à disposition. En accédant à la salle ou au spectacle, vous consentez à ce que votre image soit utilisée de cette façon. Nous pouvons reproduire et/ou publier votre image dans l’Appli, sur notre site Internet, et dans d’autres matériels promotionnels, sur des réseaux sociaux et d’autres documents liés à l’Appli. Pour plus d’informations sur la façon dont nous utilisons vos informations personnelles, et sur la procédure pour obtenir des détails sur les informations personnelles que nous possédons à votre sujet, veuillez vous reporter à notre Politique de Confidentialité.
15.3 À l’exception des Partenaires d’Évènements, qui sont en droit de faire appliquer tout droit qui leur est expressément accordé, personne d’autre qu’une partie aux présentes Conditions de Vente ne dispose du droit de faire appliquer toute disposition des présentes.
15.4 Les présentes Conditions de Vente sont régies par et doivent être interprétées conformément aux lois françaises et tout différend découlant de toute transaction avec DICE est soumis à la compétence exclusive des tribunaux français.
15.5 Si vous avez une réclamation, veuillez vous reporter aux détails de notre procédure de réclamation telle qu’établie dans nos Conditions d’Utilisation.

Su uso continuado de la App o los Servicios tras cualquier actualización de estas Condiciones de Compra constituirá su aceptación de dichos cambios. 1. ACERCA DE NOSOTROS
1.1. Somos DICE FM SPAIN, S.L.U., una empresa inscrita en el Registro Mercantil de Madrid al Tomo 39104, Folio 12, Sección 8, Hoja M- 694757, con NIF nº B -88377551, y con domicilio en Calle Marqués de Urquijo, no. 26, 3 Izqda, 28008 - Madrid, España.
1.2 Somos un agente comercial de venta de entradas a través de nuestra App y/o de nuestros Servicios en nombre de promotores, organizadores, representantes, artistas y locales de música, entretenimiento, deportes y eventos similares (nuestros “Promotores de Eventos”). Vendemos las entradas que nos asignan nuestros Promotores de Eventos, y por lo tanto, el número de entradas que tenemos disponibles para cada evento variará, sin tener nosotros control sobre el inventario o la disponibilidad de las entradas.
2. CONTRATO
2.1 Cualquier entrada comprada o de adquirida de cualquier manera (“Compra”) a través de la App y/o de nuestros Servicios estará sujeta a:
- Estas Condiciones de Compra;
- Nuestras Condiciones de Uso;
- Nuestra Política de Privacidad; y
- Aquellos términos y condiciones de los Promotores de Eventos en cuestión que se puedan encontrar en sus respectivas páginas web o en el propio local o de los que se le informe durante el proceso de compra.
2.2 Facilitamos la Compra de entradas para eventos pero en ningún momento, a menos que se indique expresamente lo contrario, actuamos como promotor u organizador de un evento. DICE no está involucrado en ningún aspecto de organización de los eventos que se ponen a la venta, y renunciamos a cualquier responsabilidad por la calidad o naturaleza de cualquier evento incluyendo, pero sin limitarse, a la vista que pueda tener en el local donde tiene lugar el evento, la calidad del sonido, las instalaciones o la accesibilidad del local.
2.3 Cuando compra una entrada obtiene el derecho conferido por el Promotor de Eventos de asistir al evento. El Promotor de Eventos en cuestión se mostrará en el anuncio del evento en la App y/o en nuestros Servicios, precedido por las palabras “Presentado por”. Ponemos a la venta entradas en nombre de Promotores de Eventos que no están vinculados de ninguna manera con DICE. Dichos Promotores de Eventos son responsables ante usted del evento en cuestión.
2.4 Cualquier cambio que se realice a un evento tras la Compra de una entrada (como un cambio de fecha, de lugar, de programa, de artista o cancelación del evento) únicamente será responsabilidad del Promotor de Eventos de dicho evento. Por favor, vea la Cláusula 3 en la que se detalla cómo le informamos de cualquier cambio a un evento.
2.5 Al pulsar el botón de ‘Comprar Entradas’ en la App y/o en nuestros Servicios, está realizando una oferta contractual de compra de las entradas. Esta oferta solo será aceptada por DICE, en nombre del Promotor de Eventos, en el momento que reciba un correo electrónico de confirmación por nuestra parte.
2.6 Al comprar una entrada, así como el día del evento, recibirá un correo electrónico de confirmación en la dirección que nos proporcionó durante su registro en la App y/o en nuestros Servicios que contendrá cualquier detalle adicional acerca del evento. Es su responsabilidad comprobar estos detalles detenidamente antes del evento. La entrada almacenada en la App y/o en nuestros Servicios, que se podrá encontrar pulsando en la opción de ‘entradas’ en el menú de la App y/o en el de nuestros Servicios, se requerirá para entrar en el local y se deberá presentar cuando se le pida a cada titular. Tenga en cuenta que en algunos eventos se le proporcionará una entrada física. En estos casos, le notificaremos por teléfono, correo electrónico o a través de la App sobre las opciones de envío o recogida de sus entradas. Es posible que en el local se le pida que verifique su identidad y/o edad a través de un carnet de identidad para eventos con restricción de edad.
2.7 Al comprar entradas a través de la App y/o de nuestros Servicios, se le permitirá comprar un número máximo de entradas para cada evento (que se especificará en la página de pedido de la App/Servicio).
2.8 Usted se compromete a no obtener ni intentar obtener cualquier clase de Servicio mediante el uso no autorizado de cualquier robot u otro dispositivo automatizado o cualquier otra actividad ilícita o no autorizada. Nos reservamos el derecho de anular cualquier Compra que sospechemos razonablemente que se ha realizado incumpliendo estas disposiciones, sin avisarle previamente, y todos y cualquiera de los Servicios adquiridos mediante dicha operación serán nulos.
2.9 Nos reservamos el derecho de anular Compras que sospechemos razonablemente que se han realizado de forma fraudulenta.
2.10 Podemos poner en venta ciertos productos (por ejemplo, merchandising), servicios y contenido digital (“Artículos que no son entradas”) para su compra a través de la App y/o de nuestros Servicios. Por favor, vea las Cláusulas 13 y 14 para más información.
3. CANCELACIONES, POSTPOSICIONESY CAMBIOS
3.1 Una vez haya comprado una entrada, no se podrá cambiar o devolver excepto que se cumplan las siguientes circunstancias:
- Si un evento es cancelado por el Promotor de Eventos, este será responsable de la devolución del importe de la entrada. DICE organizará la devolución íntegra del precio de la Compra (incluyendo gastos de gestión) a los titulares de las entradas en nombre del Promotor de Eventos siempre que obtengamos los fondos a pagar del Promotor de Eventos. Intentaremos llevar a cabo la devolución en un plazo de cinco (5) días desde que el Promotor de Eventos nos devuelva el importe que nos permite procesar la devolución.
- Si un evento es postpuesto por el Promotor de Eventos, los titulares de las entradas tendrán la opción de cambiar su entrada existente por una entrada nueva con la nueva fecha del evento o recibir una devolución íntegra del precio de la Compra (incluyendo gastos de gestión).
- Tenemos una función de Lista de Espera para eventos agotados, aplicable según el evento. Por favor, vea las Cláusulas 6 y 7 para más información.
3.2 Si un Promotor de Eventos nos notifica sobre cualquier cambio en un evento, nosotros:
- Enviaremos un mensaje al número de móvil o dirección de correo electrónico que nos proporcionó durante su registro en la App y/o en nuestros Servicios informándole del cambio; y
- Le informaremos del proceso para la devolución y reembolso del Promotor de Eventos, en caso de que proceda.
3.3 No reembolsaremos el importe de las entradas compradas después de que un evento haya tenido lugar a menos que lo pida, según su criterio, el Promotor de Eventos. No tendrá derecho a una devolución si no asiste a un evento o comete un error al comprar entradas (por ejemplo, comprar la cantidad equivocada).
4. PRECIOS Y TASAS
4.1 El precio de las entradas o Artículos que no son entradas indicado en la App y/o de nuestros Servicios incluye el IVA y será el precio indicado en la página de pedido de la App/Servicio cuando haga el pedido.
4.2 Aceptamos pagos a través de Visa, MasterCard, American Express, Apple Pay, Android Pay y cualquier otro método de pago indicado en la App/Servicio. Deberá pagar su pedido antes de que se le entreguen las entradas o Artículos que no son entradas.
4.3 Hacemos todo lo posible para asegurar que el precio de las entradas o Artículos que no son entradas que aparece en la App/Servicio sea el correcto. Si encontramos un error en el precio de su pedido, contactaremos con usted para darle la opción de reconfirmar su pedido, corregir el precio o cancelar su pedido. Realizaremos la devolución a través del método de pago usado para realizar el pedido según proceda. Si no nos es posible contactar con usted, usted acepta que consideremos su pedido cancelado.
4.4 Si necesita una factura con IVA por la Compra realizada, deberá contactar con el Promotor de Eventos en cuestión.
5. SELECCIÓN DE ASIENTOS
5.1 Algunas entradas disponibles en la App y/o en nuestros Servicios se emitirán para un asiento o área específica en el local del evento. Cuando pida dichas entradas, la App/Servicio podrá darle la opción de seleccionar el área deseada (en vez de números de asientos individuales).
5.2 Cuando haya seleccionado un área al hacer el pedido de las entradas, contactaremos con usted en una fecha posterior antes del evento para darle la opción de seleccionar un número de asiento específico para sus entradas (“Asiento Fijo”), siempre que nos informe de su selección a través de la App/Servicio dentro del plazo que fijamos para usted. Por favor, tenga en cuenta que se le requerirá un pequeño cargo a través de la App/Servicio, además del precio de la entrada, para seleccionar un Asiento Fijo. Le notificaremos acerca de este cargo cuando le demos la opción de seleccionar un Asiento Fijo.
5.3 Cuando no seleccione un Asiento Fijo según la Cláusula 5.2, seleccionaremos números de asiento individuales para sus entradas en el área que ha seleccionado al realizar el pedido. Le notificaremos acerca de su número de asiento a través de la App/Servicio antes del evento. Intentaremos asegurar que cuando haya pedido más de una entrada, a estas se les seleccionen asientos contiguos. Si tiene cualquier pregunta acerca de la selección de asientos, por favor contacte con nosotros a través de help@dice.fm.
5.4 Cualquier plano de asientos mostrado por la App/Servicio reflejará la distribución general del local en ese momento. En algunos eventos, la distribución y los lugares específicos de los asientos podrán variar sin aviso previo.
5.5 DICE se reserva el derecho de poder proporcionar asientos alternativos de igual valor a los seleccionados o fijados.
6. DEVOLUCIONES DE LISTAS DE ESPERA
6.1 Cuando las entradas para un evento se agoten, y en caso de que se acuerde con el Promotor de Eventos, DICE podrá activar una función de Lista de Espera para ese evento.
6.2 Cuando se cumplan las condiciones de la Cláusula 6.1, usted podrá tener la opción de ofrecer su entrada en la Lista de Espera a través de la App/Servicio para que se ofrezca a otros usuarios de la App/Servicio, siempre que la devolución se realice antes de la fecha límite indicada por el Promotor de Eventos. Esta fecha límite la decidirá el Promotor de Eventos, aunque DICE intentará que la fecha límite sea lo más cercana posible a la fecha del evento indicada en la App/Servicio.
6.3 Una vez haya aceptado ofrecer su entrada en la Lista de Espera, renunciará a sus derechos sobre las entradas y no aparecerán en su cuenta durante el periodo de Lista de Espera. Si las entradas que ofrece no son compradas por otro usuario de la Lista de Espera, las entradas serán devueltas a su cuenta antes de la fecha límite indicada pro el Promotor de eventos y podrá usar la entrada, sin tener derecho a un reembolso. Si la entrada es comprada por otro usuario de la Lista de Espera antes de la fecha límite, se considerará revendida por el Promotor de Eventos al nuevo comprador como se describe en la Cláusula 2.3, y sus derechos sobre la entrada terminarán completamente y se realizará un reembolso de su Compra original de la entrada. No se le abonará la diferencia (si existe) entre el precio de Compra original y el precio por el que se revendió la entrada si es más alto (dicha diferencia será la “Tasa de Lista de Espera”).
7. COMPRAS EN LISTA DE ESPERA
7.1 La App/Servicio puede permitirle apuntarse a la Lista de Espera de un evento. Si hay entradas adicionales disponibles proporcionadas por el Promotor de Eventos para su venta por parte de DICE, o si otros usuarios devuelven sus entradas compradas a la Lista de Espera según la Cláusula 6.2, se le notificará y se le dará un periodo limitado en el que podrá comprar las entradas a través de la App/Servicio (“Periodo”).
7.2 Las entradas compradas a través de la Lista de Espera están sujetas a un precio superior al precio original de las entradas. El precio de Lista de Espera que puede ver en la App/Servicio es el precio total de esa entrada cuando se compra a través de la función de Lista de Espera, incluyendo la Tasa de Lista de Espera.
7.3 Si se ha apuntado a la Lista de Espera y se le ofrecen entradas, no tiene la obligación de realizar la compra.
7.4 Al no completar la compra de las entradas que se le ofrecen durante el Periodo, las entradas se le ofrecerán a la siguiente persona en la Lista de Espera. Los usuarios que pierden la oportunidad de comprar entradas que se les ofrecen a través de la Lista de Espera durante el Periodo pueden contactar con www.dice.fm para que se les vuelva a incluir en la Lista de Espera. Un usuario al que se vuelve a incluir en la Lista de Espera de esta manera entrará al final de la Lista de Espera (y no se le dará su posición original).
7.5 Usted acepta que apuntarse a la Lista de Espera no le garantiza la compra con éxito de una entrada que se ponga en venta. No nos hacemos responsables si no recibe una notificación o si no completa la transacción dentro del Periodo para comprar las entradas que se le ofrecen.
8. COMPRAS ACCIDENTALES
8.1 Usted es responsable de comprobar los detalles del evento antes de comprar una entrada para asegurarse de que el artista, la fecha, hora, lugar, límite de edad y otras restricciones del evento son correctas y aceptables. No tendrá derecho a un reembolso en caso de que dichas restricciones le impidan asistir.
9. PROHIBICIÓN DE REVENTA DE LAS ENTRADAS
9.1 No podrá vender o transferir sus entradas excepto cuando aplique (i) la función de ‘Derecho Limitado de Transferencia de Entradas’ que se detalla en la Cláusula 10 y solo si dicha reventa o transferencia no está prohibida por ley o por el Promotor de Eventos en cuestión; o (ii) la función de ‘Lista de Espera’ que se especifica en la Cláusula 6. Además, no podrá duplicar la entrada, por ejemplo, tomando una captura de pantalla de la entrada en su dispositivo.
9.2 Cualquier reventa o transferencia (o intento de reventa o transferencia) de una entrada incumpliendo la Cláusula 9.1 conllevará la inmediata confiscación, invalidación o cancelación de dicha entrada sin reembolso ni compensación alguna, y podrá resultar en la suspensión completa de su uso de la función de transferencia de la entrada o la suspensión del uso de la App/Servicio en general para el titular original de la entrada, según DICE decida.
10. DERECHO LIMITADO A TRANSFERIR ENTRADAS
10.1 En algunos eventos, una persona que haya comprado una entrada (un “Remitente”) puede tener permiso para transferir la entrada a través de la App a otro usuario registrado de DICE (un “Destinatario”). Esto se puede hacer en cualquier momento antes de la fecha límite de transferencia y del momento especificado por el Promotor de eventos, siempre que se cumplan las siguientes condiciones:
- El Destinatario cuenta con un dispositivo compatible con la App; y
- El número de teléfono móvil asociado a la cuenta del Destinatario está guardado y es accesible desde la lista de contactos o agenda del dispositivo personal del Remitente; y
- El Destinatario ha descargado la versión más reciente y actualizada de la App en su teléfono; y
- El Destinatario se ha registrado con éxito y ha creado una cuenta DICE utilizando el dispositivo y número de teléfono arriba mencionados.
10.2 DICE proporciona esta función para facilitar únicamente la transferencia de los derechos sobre la entrada. La transferencia no se extiende al pago de la entrada, que deberá acordarse por separado directamente entre el Remitente y el Destinatario.
10.3 Debido a las restricciones impuestas a DICE por los Promotores de Eventos, únicamente las entradas de ciertos eventos podrán ser transferidas utilizando esta función. Si el evento no permite la transferencia de entradas con la función de la App, podrá contactar con help@dice.fm para solicitar la transferencia manual proporcionando el nombre completo y número de teléfono del Destinatario al que desee transferir la entrada. Las condiciones para que el Destinatario reciba la entrada se describen arriba. Deberá contactar con DICE al menos dos (2) semanas antes de la fecha de un festival o una (1) semana antes de la fecha de otros eventos si desea transferir la entrada de esa manera. Si contacta con nosotros para transferir su entrada con menos tiempo del periodo que se indica, no podemos garantizar que podamos llevar a cabo su solicitud. Cualquier solicitud de transferencia de entradas de esta manera recibida a menos de una semana de la fecha del evento puede ser denegada según DICE considere.
10.4 Cuando se utilice la función de transferencia de entradas, el Remitente será el responsable de asegurarse de que el número móvil del Destinatario es el número correcto del comprador de la entrada. Cualquier entrada transferida con éxito a un Destinatario se convierte automáticamente en propiedad del Destinatario, y el Remitente pierde todos los derechos relacionados con la entrada. DICE no será responsable cuando una entrada se envíe accidentalmente a un Destinatario incorrecto, y no podrá devolver dicha entrada al Remitente sin la autorización o consentimiento previo del Destinatario.
10.5 El Remitente será responsable de solicitar y organizar el pago por la entrada por separado directamente con el Destinatario. El importe de dicho pago no deberá ser superior al valor nominal de la entrada. DICE no se hace responsable de ningún Destinatario que se niegue a pagar al Remitente. Si se cancela un evento, se emitirá un reembolso al Remitente al ser el titular original de la entrada a través del método de pago con el que se compró la entrada. El Remitente es responsable de remitir la devolución por separado y directamente al Destinatario.
10.6 Cuando lo solicite el Remitente, el Destinatario de las entradas será responsable de realizar el pago por separado y directamente al Remitente por un importe no superior al valor nominal de la entrada.
10.7 Si el Destinatario de una entrada transferida no puede asistir al evento, las entradas se podrán transferir a un nuevo Destinatario o devolver al Remitente original utilizando el proceso arriba detallado.
10.8 Está prohibido que cualquier Destinatario pague más del valor nominal por una entrada. DICE realizará comprobaciones periódicas con los Destinatarios para asegurar que no hayan pagado más del valor nominal por una entrada. Cualquier Remitente que haya solicitado o recibido un pago superior al valor nominal por parte de un Destinatario estará incumpliendo las condiciones bajo las que se vendió la entrada y esto puede resultar en la inmediata confiscación, invalidación o cancelación de la entrada sin posibilidad de reembolso o de otras compensaciones, y en futuras restricciones de uso de la función de transferencia de entradas o la suspensión total del uso de la App en general para el Remitente, según DICE decida.
11. RESPONSABILIDAD
11.1 DICE no asume ninguna responsabilidad por las entradas compradas a través de terceros o puntos de venta no oficiales. DICE no se hace responsable de las diferencias de precio de otros medios o canales de venta.
11.2 DICE no se responsabiliza por:
- La pérdida o robo de dispositivos móviles, de cualquier entrada guardada en la App/Servicio en un dispositivo perdido o robado, o de cualquier entrada física. Todos los eventos reciben una lista con los nombres de las personas que han comprado entradas a través de la App/Servicio y nuestros Promotores de Eventos pueden intentar permitirle la entrada al evento sin su teléfono móvil contactando con DICE o un representante del evento que le pedirá verificación mediante un carnet de identidad para permitirle la entrada al evento. Aun así, esto no está garantizado.
- Cualquier acuerdo personalizado, incluyendo viajes, estancias u hospedajes relacionados con la asistencia a un evento. Ni nosotros ni el Promotor de Eventos en cuestión será responsable ante usted por experiencias negativas o desembolso malgastados.
- Cualquier coste bancario o de cambio de divisas que resulte del proceso normal de pago o reembolso.
11.3 Excepto que se haya indicado lo contrario en estas Condiciones de Compra, nuestra responsabilidad ante usted en relación a:
- Un evento (incluyendo pero sin limitarse a cualquier cancelación, cambio de fecha o cambio material al programa del evento) y la entrada que ha comprado se limitará al precio pagado por la entrada o a 5€ lo que sea superior; o
- Un Artículo que no es una entrada se limitará al precio pagado por usted por dicho Artículo que no es una entrada.
11.4 Estas Condiciones de Compra no excluyen nuestra responsabilidad (si existe) ante usted por daños personales o muerte que resulte de nuestra negligencia, fraude o cualquier asunto por el cual la responsabilidad no pueda ser excluida o restringida legalmente.
12. ACCESO A LOCALES
12.1 Su compra de una entrada a un evento a través de la App o de los Servicios le dará un permiso personal revocable por parte del Promotor de Eventos para asistir al evento, siempre sujeto a los términos y condiciones que se especifican en estas Condiciones de Compra. Al comprar una entrada en la App/Servicio, usted admite que el Promotor de Eventos se reserve el derecho, con motivos razonables y legales, a no permitir la entrada o expulsar del local a cualquier titular de una entrada sin la necesidad de ofrecer un reembolso o cualquier otra compensación. Por ejemplo, un Promotor de Eventos podrá expulsar al titular de una entrada que:
- Se haya comportado de una manera que, según la opinión razonable del Promotor de Eventos, haya afectado o pueda afectar al disfrute de otros asistentes; o
- Utilice lenguaje o comportamiento amenazante, abusivo o insultante, o de cualquier otra manera provoque o se comporte de manera que pueda provocar desorden público; o
- Según la opinión razonable del Promotor de Eventos, se encuentre bajo la influencia de alcohol o drogas; o
- Cuando, al solicitársele, no presente una prueba de identidad o edad (cuando proceda).
12.2 Al aceptar estas Condiciones de Compra, usted reconoce que DICE no tiene responsabilidad alguna si se le deniega la entrada o expulsa de un evento por parte del Promotor de Eventos o por las acciones o inacciones del Promotor de Eventos.
13. ARTÍCULOS QUE NO SON ENTRADAS
13.1 Podremos poner en venta algunos artículos que no son entradas a través de la App/Servicios (incluyendo bienes, servicios y contenido digital). Las Cláusulas 13 y 14 solo son aplicables a la compra de Artículos que no son entradas (y no a entradas).
13.2 Cualquier Artículo que no sea una entrada comprado a través de la App/Servicio está sujeto a:
- Estas Condiciones de Compra;
- Nuestras Condiciones de Uso;
- Nuestra Política de Privacidad; y
- Los términos y condiciones adicionales del Promotor de Eventos en cuestión que se pueden encontrar en la página de pedido de la App/Servicio al realizar una Compra.
13.3 Cuando el Artículo que no es una entrada es un artículo físico (por ejemplo, bienes), estamos obligados legalmente a proporcionarles bienes con sujeción a este contrato.
14. DERECHOS DE DESISTIMIENTO
14.1 Si usted es un consumidor que se encuentra en la Unión Europea o Noruega, Liechtenstein o Islandia, tiene el derecho legal de desistir de la Compra que realice de ciertos Artículos que no son entradas. Si usted es un consumidor que se encuentra fuera de la Unión Europea, no cuenta con este derecho de desistimiento. Por favor, contacte con nosotros para obtener más detalle sobre la política de devoluciones aplicable al artículo comprado.
14.2 Tenga en cuenta que cuando hayamos puesto a la venta un Artículo que no es una entrada a través de la App/Servicio en nombre de un Promotor de Eventos, cualquier desistimiento o devolución de dicho Artículo que no es una entrada también estará sujeto a los términos y condiciones de dicho Promotor de Eventos.
14.3 Tenga en cuenta que no tiene derecho de desistimiento sobre:
- Entradas u otras formas de asistir a un evento;
- Cualquier mejora o servicio adicional incluyendo viajes, comida, estancia, transporte o servicios relacionados con las actividades de ocio a ser provistas en una fecha específica o durante un periodo específico.
- Servicios, una vez se hayan prestado, aunque el periodo de desistimiento de 14 días siga en vigor;
- Contenido digital una vez haya comenzado a descargarlo o reproducirlo; y
- Bienes precintados por motivos de salud o higiene, una vez se hayan desprecintado tras recibir el artículo.
14.4 Tiene el derecho a cambiar de opinión y desistir de la Compra realizada a través de la App/Servicio por:
- Bienes en un periodo de 14 días naturales a partir del día en el que reciba los bienes;
- Servicios y subscripciones en un periodo de 14 días desde que le enviamos el correo electrónico confirmando que hemos aceptado su pedido. Aun así, una vez hayamos prestado los servicios, no podrá desistir aunque el periodo siga en vigor. Si desiste del pedido realizado después de que hayamos empezado a prestar los servicios, deberá pagarnos por los servicios prestados hasta la fecha en la que nos notifique su decisión de desistir.
- Contenido digital en un periodo de 14 días después de que le hayamos enviado un correo electrónico confirmando que aceptamos el pedido, o, si fuera anterior, hasta que haya comenzado a descargarlos o reproducirlos. Si le hemos entregado el contenido digital inmediatamente y lo ha aceptado al realizar el pedido, no tendrá derecho a desistir.
14.5 Puede desistir de la Compra a través del correo electrónico help@dice.fm o completando el formulario de desistimiento y enviándonoslo por correo electrónico u ordinario.
14.6 Si ha recibido los bienes antes de realizar su solicitud de desistimiento, deberá devolvernos los bienes (o al Promotor de Eventos, dependiendo de las instrucciones que le proporcionemos) en un plazo de 14 días naturales a partir del momento en el que nos notifique su deseo de desistir. Los bienes deberán ser devueltos en perfecto estado original que permita su venta, con su embalaje original y todas sus etiquetas, al Proveedor del Evento (en la dirección que le proporcionaremos) o a DICE FM SPAIN, S.L.U, Calle Marqués de Urquijo, no. 26, 3 Izqda, 28008 - Madrid, España. Usted es responsable de cualquier coste de envío de devolución. Para su protección, asegúrese de devolver los bienes a través de correo certificado.
14.7 Le devolveremos el importe que haya pagado por los bienes, servicios o contenido digital incluyendo los costes originales de envío. Le realizaremos cualquier reembolso lo antes posible y siempre en un plazo de 14 días a partir de la fecha en la que recibamos (o reciba el Promotor de Evento en cuestión) los bienes devueltos o, si es antes, 14 días después de que nos haya remitido una prueba de que nos ha enviado los bienes (o se los ha enviado al Promotor de Eventos).
14.8 Nosotros (o el Promotor de Eventos en nombre del cual hemos realizado la venta de los bienes en cuestión) podremos efectuar ciertas retenciones sobre el precio (excluyendo gastos de envío) para reflejar cualquier disminución del valor de los bienes devueltos, si ha resultado de su manipulación de los mismos, de manera que no se encuentren en perfecto estado original que permita su venta en su embalaje original y con sus etiquetas. Si le reembolsamos el precio original antes de poder inspeccionar los bienes, y después descubrimos que los ha manipulado de manera inaceptable, nos deberá pagar la cantidad correspondiente.
15. GENERAL
15.1 Algunos eventos podrán ser grabados con fines comerciales y/o promocionales por el Promotor de Eventos. Al acceder al local o evento presta su consentimiento a que se utilice su imagen con dichos fines. Si desea que una imagen publicada sea eliminada, puede contactar con el Promotor de Eventos y eliminará la imagen de la web o de la App lo antes posible.
15.2 DICE se reserva el derecho a obtener fotografías, audio o video de todos los eventos para los que DICE vende entradas. Al acceder al local o evento presta su consentimiento para que su imagen se utilice de esta manera. Podemos reproducir y/o publicar su imagen en la App, nuestra página web y otros materiales promocionales, canales de redes sociales y otros materiales relacionados con la App. Si desea que una imagen publicada sea eliminada, puede contactar con Nosotros y eliminaremos la imagen de la web o de la App lo antes posible. Para más información sobre cómo utilizamos su información personal y cómo solicitar detalles sobre la información personal que almacenamos sobre usted, por favor vea nuestra Política de Privacidad.
15.3 A excepción de los Promotores de Eventos, que tendrán el derecho de ejercer de manera expresa cualquier derecho que se les haya dado, nadie que no sea parte de estas Condiciones de Compra tiene derecho alguno a imponer cualquiera de los términos de estas Condiciones de Compra.
15.4 Estas Condiciones de Compra están sujetos y serán interpretados según la ley española. Si usted ostenta la condición de consumidor, la jurisdicción competente será determinada en cada caso por la normativa relativa a la protección de consumidores y usuarios. De lo contrario, usted se someterá a la jurisdicción exclusiva de los juzgados y tribunales de la ciudad de Madrid (España) a efectos de la resolución de cualquier controversia (contractual o extracontractual) que surja de estas Condiciones de Uso.

1. ABOUT US
1.1. We are DICE FM Australia Pty Ltd ACN 631 325 838.
1.2 We are a disclosed ticketing agent selling tickets via our App on behalf of promoters, organisers, managers, artists and venues of music, entertainment, sports and similar events (our “Event Partners”). We sell tickets allocated to us by our Event Partners, so the tickets we have available for sale for each event will vary and we do not control the ticket inventory or availability.
2. CONTRACT
2.1 Any ticket purchased or otherwise acquired (“Purchased”) through the App is subject to:
- These Purchase Terms;
- Our Terms of Use;
- Our Privacy Policy
- Any additional terms and conditions of the relevant Event Partner(s) which can be found on their respective websites or at the venue itself or which are disclosed during the order process.
2.2 We facilitate the Purchase of tickets for events, but at no time, unless expressly stated otherwise, do we act as a promoter or organiser of an event. DICE is not involved in any organisational aspect of the events offered for sale and we exclude any liability and/or responsibility for the quality or nature of any event including (but not limited to) your view at the venue where the event or show takes place, the sound quality, local conveniences or accessibility.
2.3 When you purchase a ticket you obtain a right to attend the event as granted by the relevant Event Partner. The relevant Event Partner will be shown in the event listing in the App, preceded by the words: “Presented by”. We make available tickets on behalf of third party Event Partners who are not connected in any way with DICE. Those third party Event Partners are responsible to you for the relevant event.
2.4 Any changes to an event that occurs after you have Purchased a ticket (such as a change of date, location, programme, or artist, or an event cancellation) are the sole responsibility of the Event Partner for that event. Please see Clause 3, which sets out how we will inform you of any changes to an event.
2.5 By hitting the ‘Purchase Tickets’ button in the App, you are making a contractual offer to purchase the ticket(s). This offer is only accepted by DICE on behalf of the Event Partner once you receive a confirmation email from us.
2.6 Upon Purchase of a ticket as well as on the day of the event you will receive a confirmation to the email address provided to us during your registration to the App containing any additional details about the event. It is your responsibility to check these details carefully before the event. The ticket stored on the App, found by clicking on the 'tickets' option of the App menu, is required for entry to the venue and must be presented upon request for each ticket holder. Note that for certain events, a hardcopy ticket may be provided to you. In these circumstances, we will notify you by telephone, email or within the App of the arrangements for receiving or collecting your tickets. You may be asked by the venue to separately verify your identity and/or age by providing ID for events with age restrictions.
2.7 When Purchasing tickets via the App, you will be limited to a maximum number of tickets for each event (as specified in the order page of the App).
2.8 We may make available certain goods (for example, merchandise), services and digital content (“Non-Ticket Items”) for purchase via the App. Please see Clauses 13 and 14 below for more information.
3. CANCELLATIONS, POSTPONEMENTS AND CHANGES
3.1 Once you have Purchased a ticket, it cannot be exchanged or refunded except in the following circumstances:
- If an event is cancelled by the Event Partner, they are responsible for refunding the original ticket proceeds to you. DICE will arrange for a full refund to ticket holders on the Event Partner’s behalf and subject to us obtaining the funds to be provided from or on behalf of the Event Partner, or to the extent otherwise required by law (including the Australian Consumer Law). We aim to do this within five (5) working days of the Event Partner returning the original proceeds to us to enable us to process refunds.
- If an event is postponed by the Event Partner, ticket holders will be given the option to either exchange their existing ticket for a new ticket for the rescheduled event date or receive a full refund.
- In accordance with our Waiting List feature for sold out events, where applicable. Please see Clauses 6 and 7 below for details.
3.2 If an Event Partner notifies us of any changes to an event, we will:
- Send a message to the mobile phone number or email address specified by you when registering with the App informing you of the change; and
- Inform you about the Event Partner's procedure for reimbursements and refunds, where appropriate.
3.3 We will not reimburse the cost of Purchased tickets after an event has taken place unless instructed otherwise by, and at the discretion of the Event Partner, or to the extent otherwise required by law (including the Australian Consumer Law). You will not be entitled to a refund if you fail to attend an event or make an error when purchasing tickets (for example you buy the wrong quantity).
4. PRICES AND FEES
4.1 The price of the ticket(s) or Non-Ticket Item(s) listed in the App includes GST and will be the price indicated on the order pages of the App when you placed your order.
4.2 We accept payment with Visa, MasterCard, American Express, Apple Pay, Android Pay and any other payment methods indicated in the App. You must pay for your order before the ticket(s) or Non-Ticket Item(s) will be provided to you.
4.3 We take all reasonable care to ensure that the price of the ticket(s) or Non-Ticket Item(s) set out in the App is correct. If we discover an error in the price in your order, we will contact you to give you the option of either reconfirming your order at the correct price, or cancelling your order. We will debit or refund the method you used for payment of the order, as applicable. If we are unable to contact you, you agree that we may treat your order as cancelled.
5. SEAT SELECTION
5.1 Some tickets available on the App will be issued for a particular seat or seating area at the event venue. When ordering such tickets, the App may give you the option of selecting your preferred seating area (rather than individual seat numbers).
5.2 Where you have selected a seating area when placing your order for the tickets, we will contact you at a later date and before the event to give you the option of selecting a particular seat number for your ticket(s) (“Set Seat”), so long as you inform us of your selection via the App and within the timeframe provided to you by us. Please note that you will be required to pay a small charge to us via the App, in addition to the ticket price, in order to select a Set Seat. We will notify you of this charge when giving you the option to select a Set Seat.
5.3 Where you do not select a Set Seat under Clause 5.2, we will allocate individual seat number(s) to you for your ticket(s) within the seating area you selected when placing your order. We will notify you of your seat numbers via the App and prior to the event. We will endeavour to ensure that where you have ordered more than one ticket, each ticket will be allocated seats that are next to each other. If you have any questions in relation to seat allocation please contact us at help@dice.fm.
5.4 Any seating charts shown via the App will reflect the general layout of the venue at that time. For some events, the layout and specific seat locations may vary without notice.
6. WAITING LISTS REFUNDS
6.1 When an event has sold out and as agreed with the Event Partner, DICE may enable the Waiting List feature for that event.
6.2 Where the conditions of Clause 6.1 have been met, you may have the option to offer your ticket to the Waiting List via the App in order for it to be offered to other users of the App, so long as the return is made prior to the Event Partner’s deadline. This deadline is at the discretion of the Event Partner, though DICE endeavours to make the deadline as close as possible to the stated event time in the App.
6.3 Once you have agreed to offer your ticket to the Waiting List, you forfeit your rights to the ticket(s) and they will no longer exist in your account during the Waiting List period. If the ticket(s) offered is not successfully Purchased by another user from the Waiting List, the ticket(s) will be returned to your account prior to the Event Partner’s deadline, and you will be able to use the ticket, but not be eligible for a refund. If the ticket(s) is successfully Purchased by another user from the Waiting List before the deadline, it will be deemed to have been resold by the Event Partner to the new purchaser as described in Clause 2.3, your rights to the ticket will cease entirely, and a full refund of your original Purchase for that ticket(s) will be provided to you. You will not be paid the difference (if any) between the original Purchase price and the price for which the ticket was resold for, if higher (with such difference being the “Waiting List Fee”).
7. WAITING LISTS PURCHASES
7.1 The App may allow you to sign up to the Waiting List for an event. If additional tickets are available for Purchase either by the Event Partner providing DICE with more tickets to sell on its behalf, or other users returning their Purchased tickets to the Waiting List in accordance with Clause 6.2, you will be notified and given a limited time period in which to Purchase the tickets through the App (“Timeframe”).
7.2 The ticket(s) Purchased via the Waiting List are subject to a higher price above the original price of the ticket(s). The Waiting List price you see in the App is the total higher price for that ticket when purchased through the Waiting List feature, including the Waiting List Fee.
7.3 If you have joined the Waiting List and offered a ticket(s), you are under no obligation to Purchase.
7.4 Failure to complete a Purchase of ticket(s) offered to you within the Timeframe will result in the tickets being offered to the next person on the Waiting List. Users who miss an opportunity to Purchase tickets offered to them from a Waiting List during the Timeframe may contact help@dice.fm in order to be placed back on the Waiting List. A user added back on to the Waiting List in this way will join at the end of the Waiting List (and will not be given their original position).
7.5 You acknowledge that joining a Waiting List does not guarantee you will successfully Purchase a ticket that becomes available. We are also not responsible if you fail to receive a notification or complete a transaction within the Timeframe in order to successfully Purchase the offered ticket(s).
8. ACCIDENTAL PURCHASES
8.1 You are responsible for checking the event details before Purchasing a ticket to ensure that the event’s artist, date, time, location, age limit, and any other restrictions are correct and acceptable to you. You will not be eligible for a refund in instances where such restrictions prevent your attendance.
9. NON RESALE OF TICKETS
9.1 You may not resell or transfer your tickets, except for under (i) the ‘Limited Right to Transfer Tickets’ feature described below in Clause 10, and only if such reselling or transfer is not prohibited by law or by the relevant Event Partner, or (ii) the ‘Waiting List’ feature specified in Clause 6. Further, you may not duplicate a ticket, for example, by taking a screenshot of the ticket on your device.
9.2 Any resale or transfer (or attempted resale or transfer) of a ticket in breach of Clause 9.1 is grounds for the immediate confiscation, invalidation, or cancellation of that ticket without refund or other compensation, and may result in full suspension of your use of the ticket transfer feature or full suspension of the original ticket holder’s use of the App in general, at DICE’s sole discretion.
10. LIMITED RIGHT TO TRANSFER TICKETS
10.1 For certain events a person who has purchased a ticket (a “Sender”) may be permitted to transfer the ticket via the App to another registered DICE user (a “Recipient”). This can be done at any time prior to the ticket transfer cut-off date and time specified by the Event Partner, provided that the conditions below are met:
- The Recipient has a device compatible with the App; and
- The Recipient's mobile number associated with the App is stored and accessible from the contact list or phone book of the Sender’s personal device; and
- The Recipient has downloaded the most recent and updated version of the App to their phone; and
- The Recipient has successfully registered and created a DICE account using the device and mobile number mentioned above.
10.2 DICE provides this feature to facilitate the transfer of the rights to a ticket only. The transfer does not extend to the payment for the ticket, which must be arranged separately and directly between the Sender and the Recipient.
10.3 Due to restrictions placed on DICE by Event Partners, only tickets for certain events may be transferred using this feature. If the event does not allow the transfer of tickets as a feature within the App, you may contact help@dice.fm to request this manually by providing the full name and mobile number of the Recipient to whom you wish to transfer a ticket. Conditions for the Recipient to receive the ticket are as described above. You must contact DICE at least two (2) weeks in advance of a festival date or one (1) week in advance of all other event dates if you wish to transfer a ticket in this way. If you contact us to transfer your ticket with less than this notice period, we cannot guarantee we will be able to fulfil your request. Any requests to transfer tickets in this manner that are received less than a week before the event may be denied at DICE’s sole discretion.
10.4 When using the ticket transfer feature the Sender is responsible for ensuring that the mobile number of the Recipient is correct for the intended purchaser of the ticket. Any ticket successfully transferred to a Recipient automatically becomes a right of that Recipient and the Sender then has no rights in relation to the ticket. DICE is not responsible for any tickets mistakenly sent to the wrong Recipient and cannot transfer the tickets in question back to the Sender without the Recipient’s prior authorisation or consent.
10.5 The Sender is responsible for requesting and arranging any payment for the ticket separately and directly with the Recipient. Any such payment must not be for a sum exceeding the face value of the ticket. DICE is not responsible for any Recipient refusing to pay any Sender. If an event is cancelled, a refund will be made to the Sender as the original ticket holder by the same means as payment for the ticket was originally made. The Sender is then responsible for remitting the refund separately and directly to the Recipient.
10.6 When requested by the Sender, Recipients of tickets are responsible for settling payment separately and directly with the Sender for an amount no greater than the face value of the ticket.
10.7 If the Recipient of a transferred ticket is unable to attend the event, the tickets may be transferred on to new Recipient or returned to the original Sender using the process set out above.
10.8 It is prohibited for any Recipient to pay more than face value for a ticket. DICE will conduct periodic checks with Recipients to ensure that no more than face value was paid for any ticket. Any Sender found to have requested or received payment from a Recipient above the face value is in breach of the terms under which the ticket was sold and that may be cause for the immediate confiscation, invalidation, or cancellation of the ticket held without any refund or other compensation and for a future restriction on the use of the ticket transfer feature or full suspension of the Sender’s use of the App in general, at DICE’s sole discretion.
11. LIABILITY
11.1 DICE assumes no responsibility for tickets Purchased through third parties or unofficial sales points. DICE is not responsible for any differences in price with other media or sales channels.
11.2 DICE is not responsible for:
- Loss or theft of personal mobile devices, any tickets stored within the App on a lost or stolen device or any hardcopy tickets. All events are provided with a door list with names of individuals who have Purchased tickets through the App and our Event Partners may seek to allow you to gain entry to the event without your mobile phone by speaking to a DICE or event representative who will ask for ID verification in order to allow access to the event. However, this is not guaranteed.
- Any personal arrangements including travel, accommodation or hospitality relating to the attendance or an event. Neither we nor the relevant Event Partner shall be liable to you for any loss of enjoyment or wasted expenditure.
- Any exchange or bank fees incurred by you arising from the normal course of payment or reimbursement.
11.3 Despite anything to the contrary, and to the maximum extent permitted by law:
- we will not be liable for any loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use and/or loss or corruption of data;
- our liability for any expense, cost, liability, loss, damage, claim notice, entitlement, investigation, demand, proceeding or judgment (whether under statute, contract, equity, tort (including negligence), indemnity or otherwise), howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent and whether involving a third party or a party to these Purchase Terms or otherwise (Liability) under these Purchase Terms will be reduced proportionately to the extent the relevant Liability was caused or contributed to by your acts or omission; and
- our aggregate liability for any Liability arising from or in connection with these Purchase Terms will be limited to us re-providing the ticket or Non-Ticket Item to you (as applicable) or, in our sole discretion, to us repaying you the money paid by you to us in respect of the relevant tickets and/or Non-Ticket Items to which the Liability relates.
11.4 These Purchase Terms do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, fraud, or any matter for which liability cannot be lawfully excluded or restricted.
11.5 Certain legislation, including Schedule 2 of the Competition and Consumer Act 2010 (Cth) (ACL) , and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees and remedies relating to the provision of the tickets and Non-Ticket Items by us to you which cannot be excluded, restricted or modified (Statutory Rights).
11.6 If the ACL applies to you as a consumer, nothing in these Purchase Terms excludes your Statutory Rights as a consumer under the ACL. You agree that our Liability for the tickets and Non-Ticket Items provided to an entity defined as a consumer under the ACL is governed solely by the ACL and these Terms.
11.7 Subject to your Statutory Rights, we exclude all express and implied warranties, and all material, work, tickets and Non-Ticket Items are provided to you without warranties of any kind, either expressed or implied, whether in statute, at law or on any other basis.
12. ACCESS TO VENUES
12.1 Your purchase of a ticket to an event via the App or Services will give you a personal revocable licence from the Event Partner to attend the event, subject always to the terms and conditions specified in these Purchase Terms. By purchasing a ticket on the App, you acknowledge that the Event Partner reserves the right, on reasonable and lawful grounds, to refuse entry to or remove from the premises any ticket holder without requirement to offer a refund or other compensation. By way of example, the Event Partner may remove a ticket holder who:
- Has behaved in a manner which, in the reasonable opinion of the Event Partner has, or is likely to, affect the enjoyment of other visitors; or
- Uses threatening, abusive or insulting words or behaviour, or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
- In the reasonable opinion of the Event Partner, is under the influence of alcohol or drugs; or
- Fails, when required, to produce proof of identity or age (as or when appropriate).
12.2 By accepting these Purchase Terms, you acknowledge that DICE shall have no liability if you are refused entry to, or removed from, an event by an Event Partner or otherwise for the actions or inactions of the Event Partner.
13. NON-TICKET ITEMS
13.1 We may make available certain Non-Ticket Items for purchase via the App (including goods, services and digital content). Clauses 13 and 14 only apply to the purchase of Non-Ticket Items (and not to tickets).
13.2 Any Non-Ticket Item purchased through the App is subject to:
- These Purchase Terms;
- Our Terms of Use;
- Our Privacy Policy
- Any additional terms and conditions of the relevant Event Partner(s) which can be found on the App order pages when making a purchase.
13.3 Where the Non-Ticket Item is a physical item (for example, goods), we are under a legal duty to supply goods that are in conformity with this contract.
14. CANCELLATION RIGHTS
14.1 Note that where we have made a Non-Ticket Item available via the App on behalf of an Event Partner, any cancellation or return of that Non-Ticket Item will also be subject to the terms and conditions of that Event Partner.
14.2 Note that you do not have a right to change your mind in respect of:
- Tickets or other forms of entry to an event;
- Any upgrades or additional services including travel, catering, accommodation, transport or services relating to leisure activities, to be provided on a specified date or during a specified period;
- Services, once these have been completed, even if the 14 day cancellation period is still running;
- Digital content after you have started to download or stream these; and
- Goods sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.
14.3 You have the right to change your mind and cancel a purchase made via the App for:
- Goods within 14 calendar days of the day on which you receive the goods;
- Services and subscriptions within 14 days after the day we email you to confirm we accept your order. However, once we have completed the services you cannot change your mind, even if the period is still running. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us that you have changed your mind.
- Digital content within 14 days after the day we email you to confirm we accept your order, or, if earlier, until you start downloading or streaming. If we delivered the digital content to you immediately, and you agreed to this when ordering, you will not have a right to change your mind.
14.4 You can cancel by emailing us at help@dice.fm or by completing a cancellation form and sending it to us via email or by post.
14.5 If you have received the goods before you have made your cancellation request to us, you will need to return the goods to us (or the Event Partner, depending on the instructions we give you) within 14 calendar days of telling us you wish to cancel. The goods must be returned in perfect original sale-able condition in the original packaging and with all tags attached, to either the Event Provider (to the address notified to you by us) or to DICE FM Australia Pty Ltd, 20-40 Meagher Street, Sydney, NSW, 2000. You are responsible for any return shipping charges. For your protection, please be sure to return your goods via recorded or registered post.
14.6 We will refund you the price you paid for the goods, service or digital content including any the original delivery costs. We will make any refunds due to you as soon as possible, and in any event within 14 days after the day on which we receive (or the relevant Event Partner receives) the goods back from you or, if earlier, 14 days after the day on which you provide us with evidence that you have sent the goods back to us (or the Event Partner).
14.7 We (or the Event Partner on whose behalf we sold the relevant goods) may make deductions from the price (excluding delivery costs) to reflect any reduction in the value of goods returned, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
15. GENERAL
15.1 Certain events may be recorded for commercial and/or promotional purposes by the Event Partner. When accessing the venue or show you consent to your image being used in this way.
15.2 DICE reserves the right to obtain photographs, audio or video of all events for which DICE makes tickets available. When accessing the venue or show you consent to your image being used in this way. We may reproduce and/or publish your image in the App, our website, and in other promotional materials, social networking channels and other materials related to the App. For more information about how we use your personal information, and how to request details of the personal information that we hold about you then please see our Privacy Policy.
15.3 Except for Event Partners, who shall have the right to enforce any right expressly granted for their benefit, no one other than a party to these Purchase Terms has any right to enforce any of the terms of these Purchase Terms.
15.4 These Purchase Terms are governed by the laws of New South Wales. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.
